faulty pram

I bought a pram from GPC 3 weeks ago, the brake doesnt work - I dont think it has ever worked but cant be certain.

I have spoken to them, they have said I can bring it in, and an "engineer" will have a look at it.

TBH, I dont really want a "fixed" pram - I want one that works - Am I entitled to a replacement? I know I could get a refund but it was on offer at the time so if I ot a refund I would have to pay another £50 to buy the same pram elsewhere.

yes...

you are entield to a refund if the goods are not of reasonable quality

lots of things are assuemd under reasonable quality
such as being free of faults
safe
and working for a reasonable amount of time

It is reasonable to expect a pram to last more than 3 weeks, so yes, under sale of good act 1979 you are legally entitled to a refund.

Tell them you will have a refund or see them in small claims court....
they should just back down and refund you, ofcourse if they dont go through small claims and im sure you will win...

so long as you havent negligently treated your pram im sure any normal person would say its reasonable to expect a pram to last more than 3 weeks

Under the Sale of Goods Act, the first remedy they can offer you is either replace or repair. If they cant do either then you can ask for a refund.

not of resonable quality

you are entitled to a refund.

if you dont want a refund and want a new one (ie replacement) pursue it, but they must also give you a refund due to goods not being of reasonable quality if that is what you want
