Is any one able to clarify something around LBBT?
I am I. The process of being bought out of my current home and will be buying a new property. I will be staying in this address until it is all complete and I would ideally move directly from this address to my new home.
Today I have been advised I will be subject to Additional Dwelling Supplement if I buy directly from this address.
I will have no financial interest in my current address when the buy out is completed and my name will be removed from all bills and paperwork.

I have of course emailed my solicitor but they are notoriously slow at responding and this I playing on my mind.

I was told this info by a vendors estate agent as a "friendly warning" when arranging a viewing

As I read it if you own one property that you live in and you sell it and buy a new property to live in it doesn’t apply. However, IANAL and have only bought houses in England. Hopefully your solicitor will be able to advise.

Yes that's my understanding also. However the agent I spoke to was insistent I'd be liable if i said at the address until moving into new property.

I've called to chase my solicitor but unsurprisingly they weren't available.

@fatsinglereadytomingle that sounds ridiculous as most people leave the property they are selling and move straight into the one they are buying.

My understanding is it only payable if you are purchasing a second (or third etc) property.

Even if there's an overlap there is a clause which applies so you don't have to pay. That's in the doc linked above.

If there is an overlap you will have to pay the higher amount and reclaim the difference if the old property is sold within 18 months.

If it’s all done on the same day it shouldn’t be a problem though.

Thanks all, just confirming my thoughts. Apparently because this was the marital home it's different. Personally I think the agent was clueless as she couldn't get her head round the fact it's an amicable split, I'm being bought out but allowed to stay as a lodger/tennant while I get new property. There will likely be a few weeks from buy out to move out but she was absolute adamant she was right and I didn't know what I was talking about even when I explained that most people sell and buy on the same day apparently that's "different"
I told her I'd like in my car to save £15k if I had to but that I was confident she was wrong
