The continuing saga of my stopped cheque

The bank ordered me a copy of the cheque - which I had to pay for. it clearly states that I did not write my card number ont eh back. I have looked in their Terms and Conditions and it clearly states that any cheque which has the card number on the back will be honoured AND it says that stopped cheques will be stopped. it says nothing about "oh well if a cheque is stopped and the person who has the cheque presents it anyway we will still honour it".
They have admitted they were in teh wrong by not following the whole process through, yet still won't give me my £50 back!

Have you tried the helpline at the Banking Code Standards Board see here. They should be able to tell you how to resolve your complaint.

HBoS. We are with bank of scotland. it's a very long convultated story. I stopped a cheque on the 21st december. The cheque was presented on the 28th and the money taken from my account. i called the bank, after several calls I got a letter admitting that the person I spoke to to stop the cheque hadn't done so, she hadn't completed the whole process. they admit that in teh letter. They then go on to say that even if she had stopped the cheque, it wouldn't make a difference as " it's our policy to honour cheque up to the amount on the guarentee card
Even though i kept telling them that I ahdn't put my number on the back of the cheque they wouldn't have it. That's when i read through my terms and conditions and as I said in the OP, saw no mention of this in teh terms and conditions. Eventually I went into the local halifax and they ordered me a copy of the cheque. I asked for my money back as they had made a mistake and they said "no, because the cheque wasn't stopped, so we still had to pay up"
I am going into see them tomorrow or Thursday at the Halifax again and I am going to tell them that if they don't pay up I shall be wrting to the Banking Ombudsman or the FSA for advice

Salt - theya re righ about honouring the cheque of the number is on the back - as it wasn't and they admitted not stopping it when you requested they haven't got a leg to stand on.

Ring the branch and make an appointment to see the manager or deputy - no excuses. ANd tell them you want it in writing if theyr efuse you. I suspect if you speak to the organ grinder it will be resolved.

Right, am off to speak to a manager at the local halifax branch today. I have my copy of the cheque, which clearly shows no card number on the back, copy of letter from Bank of Scotland which says tough luck we will always pay out cheques regardless of wether you put your card number on the back. Well it didn't actually say that, but you get the idea, and my copy of the terms and conditions which clearly says that I can stop a cheque before they are asked to pay it as long as "you haven't used your card to guarentee that cheque". Which I haven't. let's see if I get my money back!
