Any one around to give me some urgent mortgage /legal advice please?

oooh sorry, got caught up with some thing.
All it is , is that we have taken out a new mortgage and it all completed on 31st Jan. went smoothly, no probs, however my old mortgage company have taken a payment out onthe 1st Feb. This is despite having on their records that completion was 31st Jan and that the mortgage was closed.
This is also a big jump, of which they warned me, so this month we are paying 2 mortgages.
I have rang the company and they say that i could be sorted in 24-48 hours but the other day they said it would be 14 days!
We are going to be massively overdrawn and will incure bank charges and i need that money put back in my accound NOW.

what can i do???

thy have advised that i dont ring them again,but i watch my bank account, mean while im in a mess
We have a small overdraght which wont cover and which wehave never used as we have never ever been overdrawn before.

Contact your bank and see if there is anything within the Direct Debit Guarantee that they are able to do- this happened to me once and my bank clawed back the money because it was within a working day or something!

Call ASAP though

  1. Speak to bank and warn them - get a temporary overdraft. The biggest issue to me would be getting an adverse note on your credit file so if you speak to your bank you should be able avert this.
  1. Phone/ write and fax to old mortgage company and inform them that they will be responsible for any interest/overdraft fees incurred. Then you just need to hassle them until they are so pissed off with you that they sort it.

Course you can call them, they have mucked up you have every right to be angry and fully informed of what is going on.

The lady from the old mortgage company is so so lovely and its not in me to be snotty anyway.
I will go into the bank this morning and speak with them.
Will they be able to get the money back even though it was last Friday?

Not sure; you'll have to ask. If you had gone to bank on Friday then they definately could have done...... worth asking though.

If they know what the issue is then I doubt you'll be penalised if you've got a good account history

thanks kaz33 and snowflake, im a bit cross because this isnt our fault at all, and its very stressful.
why cant they jsut replace the money back into my account? They have ALL the correct information in front of them.
Is it really that hard a task to do?

To get them to make a direct transfer you'll have to pretty much kick up considerable fuss. Companies never like having to do that as they incur fees.....

if the direct debit was an error then you are entitled unde the direct debit garentee to an immediate refund

a few months ago one of my insurances took the whole years payment rather than the monthly one in one go...

i went into the bank, explained it was wrong and that i did NOT authorise that amount of direct debit and the money went back into my account the very same day. It was the BANK that sorted it for me

(the whole amount went back in, not the whole amount - the months amount which was what i expected!)
