IVA, DLA and UC

Hello can anyone help. I currently have an IVA, I am now receiving DLA for my son and I have been told by IVA that they will offset this but I have now been told I will receive money from universal credit. Which is the disability element for a child. Is this also offset for the child or would this have to be included in my income?

You need to be up front with your IP. Any extra income will need to be allocated according to need, and that's something you can negotiate with the IP (and remember, it is a negotiation - the IP doesn't want the IVA to fail either).

Worst scenario is not telling the IP, they find out anyway during an audit of bank statements, then IVA gets extended.

Definitely talk to them, but I would have thought that all the DLA and UC will be treated as income, but they will accept additional and/or higher than normal expenditure due to your DSs additional needs.

If you need to save up for equipment for him, hopefully you'll be able to put money aside, but it is unlikely that they'll accept you discounting hundreds of pounds a month of household income, saying 'that's DSs money' and then making your IVA payment based on your wages alone.

Yes I have told them about DLA then I’ve just been informed about an extra element for UC which is what I’m wondering is that mine or my sons? I’m so confused. I guess I’ll just have to tell my IVAa f hope for the best. Would just be a shame getting extra money for my son and then it taken off me when it’s not actually for me.

Yes it is treated as income but the DLA side is offset the IVA has already told me that it’s more the one from UC that confuses me as I’m not sure is that also for him or is that mine for caring for him so would be included in income.

Are you in paid work? If not you can claim carers allowance and get it backdated. Either way, you can get the carers element of UC in addition to the disabled child element of UC.
Is there a really big difference between things that are "for him" and "for you" - you pay for food, energy and water that are for both of you, and you might spend more on those things because of his health/disability. For the IVA you will just have to be up front about the costs you have.
