Compliance interview

Lula3210 · 29/11/2022 19:02

Hi there I have a compliance interview next week, it says “undisclosed capital” I’m not sure what it is? I do have credit cards and had a few loans (2-3k max) what else can it be?
my employer has reported my earnings wrong could this have flagged it up?
i do sell scentsy but I don’t make any money from it as I don’t sell enough. Does this count?

so anxious as I have had a child benefit check too recently, i feel like I’m doing wrong.

If you don’t have undisclosed money then you shouldn’t worry. You mention you are about to move into a flat, has a deposit been paid and is the information you provided to the landlord about your finances the same that which has been provided for your benefit claim?

Lula3210 · 30/11/2022 06:52

I’m not dealing with any of that. I just need to pack and move lol

The wording on that screenshot is a little odd ('or it may give doubt of your entitlement'). Are you sure it's genuine?

Lula3210 · 30/11/2022 08:06

Yes it’s on my journal

Compliance interviews usually mean they are requesting more information about a possible issue, rather than solid evidence they have (this would be an interview under caution). They are asking you to bring in evidence of the undisclosed capital, so if you don't actually have any you have nothing to worry about. It's most likely they are confusing you and your DM.

Lula3210 · 30/11/2022 08:19

Oh that’s good, I didn’t know if this was the stage before the under caution.

i have no undisclosed capital. I’m poor lol.

Do you maybe own a house with an ex and he stayed there whilst you moved with your mum?

Hadenough2022 · 30/11/2022 12:45

A compliance interview for capital can come about for a number of reasons. It can come through information received by HMRC in relation to interest on savings. These are not always accurate. You will need to provide evidence of all bank accounts I would think.
capital can also mean property. Do you own a property that you don’t live in?
capital has nothing to do with income from employment that is separate so it won’t be that.
if you don’t have any property or money over £6000 then you don’t need to worry. You can clear it up by providing your bank statements.
compliance is separate to interviews Nader cautions, it is not a criminal investigation.
It is stressful but hopefully you can clear it up quickly.

Lula3210 · 30/11/2022 14:06

So I have nothing to worry about as I have no capital… that makes me feel a bit better.

i hope it’s a mix up with my mum and it get sorted easily

If your mum has savings though that may affect your uc claim? Just like if your child had savings that would be included.

Hadenough2022 · 01/12/2022 12:08

No your mum’s savings are hers. If it was a partner then yes it would be included

LadyLapsang · 01/12/2022 14:32

Has your child got significant savings? Have you moved money from your accounts into an account for your child? Has a grandparent or relative put money away in your child’s name.

Lula3210 · 01/12/2022 17:56

No but I did transfer my sons trust fund into his name recently, it only had £700 in it.

I'm going to hedge my bets that it is because of scentsy. You say you sell it so they will probably have received a report from someone about it and want to check your income from it. I know you said you make no money from it but maybe they want bank statements or the likes to prove thats true? Have you kept track of incoming and outgoings since you started?

LisaJool · 01/12/2022 18:31

Did you declare the Scentsy job?

Lula3210 · 01/12/2022 18:43

no I haven’t (I know I completely should have£but I have got all the receipts for it. I guess it could be that. I just thought as I wasn’t making money from it I didn’t need to report it.

hopefully it’s a slap on the wrist and I’m happy to pay back anything I owe

I’m not sure what benefit you are claiming, but are you expected to be looking for additional hours of work to supplement your current part time employed work? If that is the case, possibly working at a second self employed job, even though you are not currently making a profit, could be viewed as limiting your availability for work / job search. Did they not ask about self employment when you made your claim? I would guess they may want further information to ensure you are not delaying payment for work done until you move in with your boyfriend / terminate your claim.

Lula3210 · 01/12/2022 20:08

Not expected to yet as I have a young child (under 3) my claim started 2019 and I didn’t start scentsy until last year, so it may well be that, I’ll just be very upfront and apologise and I’m happy for them to recover all I owe! I’m so stupid I should have updated online, I just didn’t think because I wasn’t making anything the time I bought stuff but I suppose it’s my fault

Is your child now an adult? You mention transferring the Child Trust Fund. Are they still in full time education / classed as a dependent child?

LadyLapsang · 01/12/2022 20:10

Sorry cross posted

LadyLapsang · 01/12/2022 20:12

Yes, just tell them.

Lula3210 · 01/12/2022 20:27

No he’s 16, still in full time education

Hello,
I have just had the same thing, I have NO savings or property, the only thing I can think is my daughter is 18 and going to university in September and she applied for her student loan last month and this week received word of the amount she would be receiving, which is around £9000. She still lives with me and shares the same surname, would this is be the reason I have received an invitation to a compliance interview?
Thank you
