Housing benefit question, DLA and working non dependent

I have a question and if anyone here can advise me I would be very grateful.

My mum currently claims DLA and gets full housing benefit. My brother is 26 and will be moving back in with our parents in a few months. He works full time and earns a decent wage.

My question is will my parents lose their housing benefit once my brother moves in?

Yes, if he’s earning he will be expected to pay the rent. Housing benefit is based on ‘the household’ and he will now be part of that household.

If it's old fashioned housing benefit they will get a non dependant deduction based on your brothers earnings

Thanks. I read somewhere that the deduction is excluded if you claim disability living allowance. Im guessing that's not the case here

Your brother will not be expected to pay the rent as he will not have a tenancy agreement

It depends on what rate of dla they are on, if it's care or mobility, high rate etc

It's for care. It will become the responsibility of my brother as he will be the only one who can afford to pay the rent cost.

You have read correctly that non dependent deductions are ignored for housing benefit if the claimant has DLA.

So whilst my brother lives there the housing benefit situation will remain the same even if he's working full time?

There is no non dep deduction whilst the claimant (or partner) is in receipt of dla/pip/aa. Your mums HB amount will remain the same after your brother moves in.
