Refund from EBay/credit card?

I bought a PS5 from EBay as I couldn't find them available from any retailers at the time. It was for my sons birthday.

Description was brand new sealed box, photos confirmed and seller seemed to have a genuine history. When it arrived everything looked fine with the box so I put it away for DS birthday.

He opened it and it failed during the start up process. All online troubleshooting points to it being 'bricked'.

I paid via credit card on PayPal.

Seller won't accept a return and closed the case, and I can't seem to find a phone number or way to escalate this to eBay for them to intervene.

I've lodged a claim with my credit card provider, they say it takes 4-6 weeks to process.

What are the chances of getting my money back?

I've been told by the seller to claim under warranty to PlayStation but there are so many things that could have gone wrong that are excluded under warranty. I feel like if it's dead out of the box, I need to reject it for a refund. Not accept it and attempt a repair. Am I right?

I've managed to get another one online now, so if I'm wrong I will end up being £520 out of pocket and I really don't have that money. I've saved for months to get him this. TIA

Did you raise a 'not as described' case via eBay? I honestly did not think a seller can close one of those, it's up to eBay to determine who's side prevails.

If you can evidence to eBay that it doesn't load, they should force the seller to accept the return as the item is not described. You should also be refunded.

I would honestly get your money back and buy a bundle elsewhere. They are increasingly available now- I believe the Playstation store itself has it available online now. It's just the base console which is out of stock at the moment.

It was just over a month. I know. I inspected this box and it was sealed so I was satisfied. I can prove it was my sons birthday though, and I'm hoping it all sounds legit. I have pictures taken on the day of it being unwrapped and a video of it not working.

If this is you OP you appear to have had a NC, which makes your final post difficult to spot.

Unfortunately after a month, then I don't think you can claim a not as described. Anything could have happened to it during that month it was in your possession (I know that's not the case here, but there has to be a limit somewhere).
Try claiming from PlayStation and if they can't / won't sort it, if you paid on credit card you can submit a Section 75 claim:

Why is this please? It is on my credit card and then paid via PayPal on eBay. I thought this would give me maximum protection across 3 different organisations? Many thanks

Section 75 requires a direct connection between the buyer and seller. If you go through a third party such as PayPal, then that connection is broken and the credit card company may refuse the section 75.

If you use PayPal, you are better off using PayPal Credit, then you get full section 75 protection.

Just thought I'd update this. I raised a case with the credit card but have still not heard back. I also raised a case with PayPal because of this thread. They agreed to a return and asked me to post the PS5 back to eBay. It was sent to them, not the seller and was independently inspected. They had it for around 3 weeks and have finally made the decision today to refund me. Such a relief. And a lesson learned.
