Stuck paying for a damaged item on finance as company went into liquidation!!

Bought a set from luxuryrattan.com for £1439 a couple of months ago, arrived but with significant structural damage, spoke to company on live chat who said that as soon as the item was back in stock we'd receive a replacement

Since they've gone into liquidation, contacted Novuna finance who are submitting a claim on our behalf, I'm just panicking as if I'm asked for proof that they offered a replacement I don't really have it as it was all on live chat and I didn't receive a follow up email with what the chat said. Feeling like an idiot.

I have photos of the damage, proof that I sent them this on Instagram, I messaged them on Instagram and then found their live chat and got it sorted through there, they replied the next day through their Instagram to which I replied saying your live chat have arranged a replacement but that's all I have in terms of proof. No emails, nothing in writing from them. This claim won't go anywhere will it? I want to cry Sad

Did you sign to pay by direct debit? If so, cancel it immediately because you have not received the goods you paid for, have you? They cannot force you to pay for something you don't have.

The goods arrived damaged and are not fit for purpose. They can come and collect the goods and that will be an end to it.

The company can't collect them because they are in liquidation and have completely vanished without a word, nothing no social media or website they are just gone

Novuna finance (external company not who the set was from) have they said they can make a claim for a refund and cancel our agreement but I don't know if they're going to come back and ask for proof and if they do I don't have any Sad

Your credit agreement with d/d payments would be with the finance company, not the place that has gone into liquidation. Businesses don't run their own credit agreements, they outsource them to finance companies.

Cancel the direct debit anyway.

Don't just cancel the direct debit, that's a sure fire way to end up with a marker on your credit file and/or CCJ proceedings.
I've found this though:

"If you paid for goods on finance arranged by a trader or if you paid using your credit card and the goods cost more than £100 but less than £30,000, you have rights under the Consumer Credit Act 1974. Section 75 of the Act makes the finance / card provider as responsible as the trader for a breach of contract or misrepresentation. This includes supplying faulty goods. You are entitled to take action against the trader, the finance / card provider or both."

The company name is Littleborough Furniture Company, still listed on Companies House as active, if that helps at all.

Submitted a claim online with Novuna - fingers crossed.

I've googled them and can't see anything from them saying they are in liquidation but all traces of them online are gone, there are reviews from people saying they've gone into liquidation and taken their money and not delivered and mentioning email responses saying as much but I've not had any emails. I can't find contact details to get in touch with the other company name mentioned. Hopefully the finance company can solve it..

I'm in the same situation but I do have evidence that they agreed to replace my damaged product, I've just contacted the finance company to see if there's anything that can be done to get my money back or if I can stop paying due to the fact they have not delivered a working product.
