Does anyone have one for their child? DS who is 11 and severely autistic,will realistically never be able to manage day to day money..im a single parent with no family or friends..i want to set one up ( i cant work anymore,his needs are too high)..and i have no one to be trustee..i cant seem to get any advice without paying huge soicitors fees..am i write in thinking that the trust only kicks in after my death? Any advice appreciated

Following as this relates to my step brother. My dear step mum told me about a charity that offers trusts at reasonable rates. I will ask her about it when I see her next.

Marking place as I am in the same boat, just don't have anyone trustworthy to appoint as trustees, there are some potential selfish "discretionary beneficiaries" though who would not take a slightest interest in anyone else's wellbeing, never have.

I have heard of advocacy services but not been down that route yet, I am thinking this might have to be mentioned in any trust or will and then it can be actioned.

I think advocacy has fees but I thing if stipulation is a regular visit/review than that's more likely to happen.

I would be interested to hear if anyone has used the advocacy services.

I know my sister who is in a similar position with schizophrenic adult son who is very impulsive and has manic episodes too has asked me to inherit his share when she and her DH die and to give him X amount a month and if he asks for extra, which he does to her a lot, see if it is for something sensible like a new coat etc or does he just want more for cigarettes. I am not keen to do it because I am only 7 years younger than her and wonder if I did agree to it what would happen if I died too. She could ask her dd to do it but is worried he will just nag and nag his sister all the time.

Thanks all..i just spoke to mencap and also am independent solicitor..mencap ive decided isnt an option as they take full control of the trust and visit once per year after my death..they also take a yearly fee and i dont have a massive amount to leave for my son...the solicitor has told me to open up a savings account now..get money in for my son.just before my son is eligible for benefits i should contact the solicitor who will set up the trust for a fee of 650pounds plus vat.( probably more in 7years time).the money in savings will then become the trust and i can do it with one trustee..means tested benefits will not be effected for my son if i do it before he turns 18..i thought i could so it now but i cant pay in gradually.it has to be done in a lump sum..but i can add to it once its set up.hope this helps guys

Thank you for coming back on this, mine is over 18 now so I suppose it would be the same, just set up a trust whenever we need. He does have a small amount in savings. But i need trustees, that's where I am stuck.

I still hope someone on here might have experience of advocacy, I think this might be provided by the local council(?).
My main concern is that someone needs to be aware whether he is in a suitable placement if/when we are no longer around, plenty of bad stories around. For now, he is living at home.

Did the solicitor say or do you know please, if the trust us set up as you said in savings first then transferred before means tested benefits, can any inheritance be added later? So if/when we die can his share of our home automatically go in the trust or would that need to be another separate trust please?
