Neighbours builder cut into our property despite being denied permission

Apologies if this the wrong section.

Out neighbour wanted to widen their side passage and their builder asked if he could cut out a sizeable corner of our decking (about 1m square) and also cut back the fence about 1m to enable this.

There had been no prior discussion - this was just the builder asking as I left the house.

Unsurprisingly I said no but would be back later and listen more then.

When I returned, they had gone ahead and done it.

Can anyone advise of my legal remedies?

I'd start by taking photos and then talking to the neighbour. It might be possible to sort it without taking legal action and that will probably be quicker and cheaper.

As others have mentioned contact your household insurers as you're likely to have legal cover with them. In this case I wouldn't discuss it with the neighbours at all just leave it with the insurance company's solicitors.

But your neighbours have employed the builders and must accept their responsibility for any unlawful action or damage by the builders. It's a civil matter so the police won't intervene. Good luck with sorting it
