Anyone know how you go about applying for this, the ins and outs of the process and who is entitled? Thanks.

You can apply for compensation from the Criminal Injuries Compensation Bureau and if its less than £5000 you can take it through the Small Claims Court (i think). If you involve a solicitor they will probably get you to sign a Contingency Fee Agreement which will enable them to take a cut of your compensation (prob 25-33%) - its really not worth it - do it yourself.

try this

Did the prosecution not as for a criminal compensation order at the time of the trial? If not, it's a shame as it would have avoided the need for you to do it yourself.

You can apply through the Criminal Injuries Compensation Authority:

Application forms are available from the CICA or can be completed on their website:
Tay House
300 Bath Street
Glasgow G2 4LN
Tel: 0141 331 2726 (telephone and textphone)
Fax: 0141 331 2287
Website: www.cica.gov.uk

Freckle · 25/11/2004 18:53

Sorry, that should be "ask for", not "as for".

fairyfly · 25/11/2004 18:56

No freckle, i have a feeling im not eligible really, its just a thought as others have told me i should. Still not decided if i agree yet. But nothing was ever mentioned (as far as i know).

What would you need to know, the actual court case charges or the incident?

Thanks for your help, i don't really want to go into detail anymore but it was a break in and sexual assault. I doubt i'll do anything about it, just curious really.

Do try your CAB, FF. DH was unfairly dismissed a few years ago and there was a bloke at ours who was fantastic at sorting things out, writing up statements etc on the way to the tribunal (which never happened in the end but he would have represented DH there too if the other lot hadn't caved in ahead).

We could not have paid a solicitor, and without this chap DH would have caved in and let it go, and we got nearly £10K in the end. Go for it!

Thanks, W'n'R!

I was a bit frustrated at being deprived of the opportunity to eyeball the bastards at the tribunal, but DH was relieved it was all over (and the CAB bloke was seriously considering barring me from the proceedings! )

fairyfly · 25/11/2004 21:13

Court Eyeballing is to be avoided at all costs in my opinion. Will go to cab, there is a form to fill in on line which seems fairly straight forward though. Still umming and arring.
Glad you won too jan

Hi fairyfly
I too was the victim of a sexual assault and after being advised by the police have applied for compensation. The process seems to be taking ages (11 months so far) and i have moved away and changed careers in the meantime. But should i be awarded any money it will do little to help the fact there was not enough evidence to convict. Thus the police advising compensation. I feel 150% better a year after the assault, and my life is back on track. I hope that you too will heal. I know how hard it is. Very best wishes.

fairyfly · 04/12/2004 08:26

Only just seen this nannyk and i'm sorry you have had such a trauma and he wasn't convicted. Seems like you are getting your life back on track with a new job and area. I know how tough it is, more than you can explain, weird how much it effects you without realising. My confidence went so i think you have been really brave in finding new work etc. Good luck.
I get the impression then that you only really apply for it if no one was convicted, is that the case. I don't want to take advantage of the system and maybe they will not award me anything. As you can see i'm still swaying with this one.
