does anyone work for a insurance company?

hi just wondering if anyone out there works for a insurance company as i need some advise. my garage was broken into a while ago 2 bikes and a childerns car that belonged to me were stolen, and some tools belonging to my dad. the insurance company are saying that they will not pay out for the tools becasue they are my dads and he should claim on his insurance. trouble is my dad moved to spain earlier this year so obvistly his policy wont cover him, and i feel a bit shitty as the tools were pinched from my house. if they dont have to pay out is there any way i can ask them for money instedad of one of the bikes so i can replace his tools myself.
please help i feel as if they are taking the piss as they have questioned everything i have claimed for. x

lolliepops - sorry to hear about your breakin. Unfortunatly you must have insurable interest to claim i.e. you must gain by its existence and suffer by its loss.

misshoolie what i dont quite get what you mean? i think it is stupid it was in my garage someone pintched them, i pay insurance every month, they should just stump up and give me the tools back. or what the hell is the point of paying insurance!!!i am in rant mode

the premise is that if it dosn't belong to you then you don't suffer if it stolen. Your dad is the one who should claim. I know he is in Spain. Will they be actually providing you with new bikes or giving you a cheque.

The point is that your insurance only covers your possessions. In thoery, your dad's tools would have been covered by his own household insurance (provided they were covered "away from home").

Are you sure your dad didn't give you the tools when he left the country... they would be yours then. Of course, depending what you said to your insurance company this may not be viable. I have to say that. in those circumstances, I would not have said that any stolen items did not belong to me.

soupdragon i guess i am just new to all this claim stuff and never even gave it a thought, i guess they would just laugh at me now if i said " i didnt realise at the time when my dad left them here, it was because he was giving them to me"!

the bikes are being replaced by a bike company i just wondered if i could say i wanted money instead, unlikley i know!

theiving little bS if it wasnt for them i wouldnt be out of pocket

I'm an insurance claims analyst and there are many arguments you could use with the insurance company....Have you gone through a broker????? The broker should be working on your behalf and so should find ways in which to help you. You could use the argument as everyone says that your dad gave you the tools! Write and point out that as your dad moved to spain, he obviously had no intention of taking the tools back and so they were yours. Possession is 9/10's of the law after all Companies can be difficult but i have been in situations where the insured has continued to stand there ground and the companies have thought is it really worth it? and then paid out. If you need further advice CAT me with more details and i'll try my best to help.
