PLEASE PLEASE call & check that your past and current records are correct.

Today I discovered in a 3.5 hour call that despite my paperwork saying I was in receipt of the disability element, I actually haven’t been receiving it. And that led to a whole host of issues….

This discovery was made because I simply said just one word. Seemingly an employee noted that I had called back in 2017 and said my PIP had stopped. This meant my disability element of tax credits had stopped. In actual fact, my basic rate of PIP had stopped and I had been put onto the enhanced rate….but this had NOT been noted by the tax credits staff. 5 years ago.

Staying on top of all the figures, submitting online any changes the very month they happened, even down to a difference of £10 in childcare costs for just one month, to completing and submitting my figures as per my tax return within 3 days of the renewal pack being received, yet out of nowhere I got a Notice to Pay a month ago for £6k. If this wasn’t paid within 30 days, the Debt Collection Agency would be involved.

I don’t have the funds, my DH very recently lost his job through no fault of his own, and because of this ‘overpayment’, made by DWP to me, my tax credits ceased with immediate effect. Which meant my NI Contributions also stopped being paid to me alongside our other loss of income.

Another bill came today for a further £3k, hence todays long call. The call-handler was wonderful. Empathetic, calm, patient and understanding. He explained everything and we found the reason and solution….I am now back on tax credits, with retrospective disability element reimbursed for the last 2 tax years (all he can do) BUT it is absolutely petrifying that this happens to people who don’t feel confident in making calls, don’t have the mental or emotional capacity to deal with this and it’s not ok that this happened. It’s incredibly worrying that others may find themselves in this position and wouldn’t know what to do, that they would have just made the overpayment without questioning it or worst still, borrowed from a loanshark or spiralled into a depression from this scenario.

If it can happen to me, it can happen to anyone. I was pro-active, honest and communicative all the way along, all my figures were correct and I was prompt and on time in submitting from the start back in 2015.

Please, never assume they have it correct. The wording on their documents can be meaningless.

But if you told them your PIP had stopped it's not unreasonable that they will stop the disability element surely ? Why did you not just say it had increased?
Also do you not receive annual statements that would show that your disability element was missing? i remember when we used to receive them years ago, there was always loads of paperwork sent , often duplicates to both me and dh.

Tax credits are notorious for overpayments though and this is why they are trying to get everyone onto Universal credit - it's so much simpler and based on real time information so much less chance of these kinds of massive errors occurring. Glad you have got it sorted.

Also I think I would challenge them as you ahve missed out on 3 months worth of disability element. Perhaps speak to CAB . I'm not sure how long they keep recorded phone calls on record, but if a call handler misinterpreted what you were saying, then maybe there is someway this can be proved who said what on what call. I guess it must be hard to know exact dates from so long ago, but always keep a record of calls from now on.

I found out a few weeks ago that dh's self employed hours have not been recorded despite me entering them every time we renew our tax credits. As a result the overpayment we had paid back 2 years ago is most likely not an overpayment at all. I am currently fighting with them to sort it out. Its the most complicated, obtuse, deliberately confusing system I have ever had the misfortune to have to deal with.

The call I made in which I categorically stated my basic rate of PIP had stopped because I was now in receipt of the enhanced rate is now being investigated. Todays call-handler spent an awfully long time going through all my previous log-ins and calls and could see the date and exact time and exactly what was said by me; it was back in March ‘17 and it correlates with a letter I received a week afterwards confirming my statement.

Yet the error still occurred.

Apparently this investigation will take at least 3 months but tbh, I’m fine with that. I know what I said. My reimbursement will be received within a few days….hopefully!

I just wanted to raise awareness that errors happen no matter how cautious and conscious and honest you are. Just one wrong key on the keyboard at their end can cause be catastrophic for someone else 😔

Surely if you had already been in receipt of standard PIP rates and then awarded the enhanced rates you would have noticed a big drop in the amount you received if the disability premium was then missed off ?. As far as I'm aware there is no difference in the amount of disability premium received for enhanced rate

Regarding tax credits I was never given a financial figure explaining the difference or discrepancy between the two. @Babyroobs Regarding PIP itself, yes, absolutely.

£300 clearing into my account tomorrow! That’s what saying one word & questioning something does.
