Is this not fraudulent?

Went out for a meal last week. Split the bill with a friend. Her credit card transaction got declined although we had left the restaurant in a hurry to catch our train so didn't know until I noticed they had charged me twice on my card to make up for hers being declined.

I had used contactless to pay for my share of the bill but mist certainly had not agreed for it to be used for her share.

There's no issue with me getting the money from her but can restaurants actually do this (their defence was that the table bill needed paying no matter what).

Jesus - no, no open tab or deposit paid for the booking. Tbh, we didn't even book, just walked in and asked if they had a table free

Update:

After contacting the restaurant, they've now refunded me the half they erroneously charged to my a/c. They asked for my friend's contact details but I wasn't prepared to give them these and have said I'd flag up to her what's happened. There'll be no issue of her paying so I guess it'll all be sorted now.

No cvm is what is displayed when it’s tapped contactlessly.

keyed means they types your card details into the machine manually (like if you paid over the phone.)

if you didn’t authorise it it’s fraud.
they know that which is why they have reduced you.

im glad you sorted it, I hope your friend still pays them though.

There's no issue with my friend paying them. However, interestingly, her bank has advised that the restaurant's actions have indeed been fraudulent in a number of ways, not least as they sent me via text message a photo of the declined cc receipts as evidence her payment had been declined (these receipts had her full credit card number on and expiry date of cc!). Anyone could have picked up my phone and seen these. Pretty sure that's a fairly serious GDPR breach ... The bank actually froze her card as the restaurant had actioned so many attempts to take the money from her a/c.

You have data you should not have been given and I am guessing that the senders phone was not a company owned phone either.🙄

On my work card machines when a reciept says no cvm it's a contact less transaction.

I used to work at a hotel. We regularly put through payments without the cardholder being there. (I'm going back around 13yrs ago). When you tap your card, two receipts are produced. One for the restaurant and one for you. The cardholder receipt has some of the card numbers blocked out, that's the one you take. If you drop it, no one can get your details. But the receipt for the hotel/restaurant shows your full card number with expiry date. My assumption (and please bear in mind, this is only my assumption) is that when your friends card was declined, they manually punched in the card numbers from your receipt into the card machine and processed the payment that way. When I worked at the hotel, we would do this if guests left without paying or damaged a room without paying. They would give us their card details at check-in, so we had them stored. Trust me when I say, companies absolutely store your card details, even if they say they don't.

I was going to suggest something like this but wasnt sure if it was possible without the number on the back of the card

From what I understand reciept 2 should not be listing CVM if a pin was used. If you have the original reciept issued to you can you check if the authorisation code matched reciept 2 as the authorisation should be the unique to a single transaction.

Yes, the timing's about right. My customer receipt matches the one which says 'No CWM Used/contactless' and is timed at 18:40. I didn't use a pin but rather the contactless facility. The Authorisation code is the same. However, I've noticed that on my receipt it says 'Re-Print. Merchant Copy'. I hadn't even noticed that before. Perhaps this is what all customer receipts say ...?

Where j work my machines don't automatically print a receipt for a contact less payment. If customer wants a scientific we have to reprint our copy
The other reciept says keyed, they've Manually entered your card number from your 1st receipt. I'd get onto your bank and report it.

You can download forms to make a complaint about them giving you her details and taking the extra money from your card.

They will be fined and you can claim compensation.
