Universal Credit LCWRA Backpayment

Hi all. I am new just looking for some advice on backdating of LCWRA. Bit of a long one so I do apologise in advance..

Background:

I had a severe motorbike accident in November 2019 leaving me with a fixed metal jaw, a bleed on the brain, cracked skull and various mental health factors. I have also been diagnosed with a learning difficulties and an impairment. I first notified UC of this change and uploaded my first sick note dated 13th November 2019 - 6th January 2020.
Due to COVID all things were slow and I was then asked to provide a further fit note dated 1st April 2020 - 1st July 2020.
No more fit notes were added to my journal during this time from July 2020 until a WCA assessment was arranged for me in June 2021.
The outcome of this assessment was that I was found capable of working. I then asked them for a Mandatory Reconsideration of this which again they denied. I then took this to the Tribunal and on 9th March 2022, it was decided by the Judge that the decision of the DWP be overturned and that I be awarded with LCWRA.
However, since 9th March 2022, I have had no communications with UC despite leaving several messages in my journal.
They should have received a copy of the outcome by now from HMCTS.
I am also racking my brains as to work out how much I will be receiving a back payment of due to not actually been able to work since November 2019 and being constantly fobbed off by UC.
I know/understand you have to wait an initial period of 3 months from the date you first upload a sick note this should of then triggered a WCA in February 2020 but yet again did not and the WCA was not carried out until June 2021 and not receiving a decision from the HMCTS until March 2022.
Could anyone please give me some help and advice on this and how much I should be roughly expecting from them as a back payment or whether it will be the normal “3 months”.
My assessment period is from 13th - 12th every month.

You do need to hand in fit notes with no gaps to be eligible for the back pay etc

Hello everyone, im just wondering if there is anything i can do to find out whats going on with my claim..
I sent my medical form back to uc in November 2021 and i hasn't heard anything at all... i did ask my coach and she said they dont know anything other than my forms have been received..
Im just so confused is this what they do just leave u waiting around for months??
Just i know of people that have had theirs back within a couple of months..

Any advice is appreciated 🙏 🙂

Yes it can take months to get called for a work capability assessment. they may be chasing up medical evidence etc. Did you send medical evidence/ letters with the form? It's just a waiting game really but if oyu are concerned you can call CHADA ( centre for health and disability assesments ) who are the department who deal with the assessments. I usually find they are the best people to tell you what's happening and you usually don't have to wait long on the phone which is a bonus !

Yes i did send some in, and my dr said he filled out a form in December that they had sent to him..
Oh iv never heard of them! I will definitely give it a shot..
I just dont understand how some people can get them back within couple of months and others have to wait near on a year 😕 xx

I'm on lcwra and I've only recieved £320 not full amount also does this mean I've not been given u/c this month ?

Have you got any deductions for earnings on your claim?

Hi I first made claim and provided sick note around Feb 2022 I've only just now had my assesment over a week ago and received a letter saying there awarding me lwrca which starts end of month. Am I entitled to back payment from when I provided sick note?

You will be eligible for backpay from the fourth full assessment period after you started handing in sick notes.

Even although I work I have to accept my commitments. My commitments are to inform them of changes and communicate as requested essentially. They send an email quarterly I think. Go to to do list read and accept commitments. Then read and accept sanctions.

It does seem a bit pointless; I have wondered how many people miss the email and don’t get any money. It doesn’t show up
in your journal only on your to do list.

@Louie2018 you will not get back pay, you don’t get back pay you will just start getting paid on the 4 th month and that will be your monthly amount

Sick notes have to be continuous without any gaps, or else you will only be backdated to the period where they are all joined up, sick notes only stop once you've been placed in LCW or LCWRA after assessment. Even a 1- 2 gap can result in no backdated payment. I know I've been in that situation myself.

Hi i was put on lcwra on the 4th after having my assesment on the 2nd ive also been handing in sick notes from june until present day wil i get backdated money from june to september its really complicated to understand

After an unsuccessful MR, a different work coach in August 2023 suggested I resume submitting sick notes, leading to another WCA that never happened due to the ESA assessment. Also, although I stopped handing in sick notes to UC for the few months, all the dates on my sick notes are consecutive and related to the disability I encountered from my accident.

Should UC backdate payments, and if so, from when? Thanks in advance.

Sounds a bit complex but I would have said from August 2023 as long as sick notes were submitted to ESA continuously.

Did the judge order them to pay back money or just to start it then? I was only given 3 months of back pay even tho I had put sick notes in for almost 3 years until they were ordered to give me the benefit. I hope your getting your ESA and DLA aswell. Took many many times of applying and interviews with them but I eventually got it. I found it hard because I worked since I was 16 full-time until late 32 then it all went wrong and I suddenly went from a good paying job to nothing. I actually refused to apply for ESA and DLA for a long time over a year and used my savings to live. Eventually family and friends persuaded me and I still nearly gave up twice when I was rejected. Anyway long story short after a very long time from age 36 I've had it the last 2 years and it has been very helpful. But to get it was a nightmare
