Retired executor

My mother in law died at the end of July and we are going through Probate.

She had a will that had a named executor who is a solicitor but now retired. The company who have took over their affairs have written to the retired solicitor to get him to sign the executorship over, however this was now over a month ago and nothing has happened.

Our solicitor is chasing and we have emailed too but they just say it is beyone their control. We have paid £200 for this yet it seems nothing is happening or being chased.

Where do we stand with this. any advice? I am asking our solicitor too but was just wondering while we wait.

If you cannot get an executor to act I'm afraid it looks like you'll need to make an application to the court:-

But don't stress too much - the courts are very used to this; it happens all the time.

If you can, why not write/phone the guy yourself?

Thanks. I would contact him but can find no trace, the solicitors who have taken over have his contact but i dont suppose they would pass on his address.

I had to do this. I made an appointment at the local probate court - which was located in our nearest town in the magistrate court place. The man I saw was very helpful and it was pretty straightforward.

No - he totally understood the situation and pretty much rubber stamped it. I think there was a form or something.
