I'm owed money a nursery that's gone into administration.

The nursery (part of a group) went into administration in Sept. Some branches closed but mine was being sold.

I was informed Tuesday that it might close on Friday if no sale had been made.

I found a new nursery that day and informed old one on the Wed that it would be ds last day.

I was told to go to the administrators for a deposit refund and also my account is £20 in credit. I wrote a letter saying that as we were given less than a week's notice of impending closure (and 24 hours notice of actual closure) parents were entitled not to give one month's notice back.

Somone has just posted on the nursery thread that the administrators told her she'd be unlikely to see any money back plus she says she's got debt collectors after parents for money they supposedly owe (her branch closed about 6 weeks ago).

What can we do?

so, how much money are you actually owed, is it a lot or is it the principle?

mumsville · 30/11/2007 12:12

Not alot.

It's my deposit £100 plus due to an error on their part I'm £20 in credit.

I joined when they were in administration so I don't think they can say to me that the terms of my contract have changed.

Not only that it seems that parents from other branches of the nursery that shut down a month ago are in the same position and have also had debt collectors trying to get money from THEM!

If it's in administration, you will probably be way down on the list of creditors, lenders and utilities will take precedence so anything left over will be shared out amongst remaining creditors. It's quite likely that you will never get your money back.

Why should customers be last on the list! We were the ones that made their business, not british gas.

What makes me suspicious is that if debt collectors are in already for the earlier closures, this is down the administrators, who have responsibility for the company right now. How can they chase people to who they owe money, for money!

I think, if I'm honest, I'm pissed off at the way customers and staff have been treated.

I am afrais mumsville, that this is totally the norm, once administration starts.
realistically, you don't stand a chance. Literally. Unless you choose to take some of their fixed assets - a tv or something that you could sell. Not advising this, just saying that I have a little bit of experience, and you won't see a penny.

Puts a rather horrible spin on childcare. But there you go.

There is a set order for satisfying creditors. Customers usually at the bottom I'm afraid. Administrators will be seeking to get as much of what is owed as possible to then redistribute the assets among them.

Mumsville - you said you joined when they were already in administration. If this is the case, then the administrators are responsible for the payment of creditors, and you should be paid. Speak to the administrator about it.

Ah hah - I will!

I think more than anything I'm so upset by the way it was handled -also the fact that I'm pretty sure that the lovely and loyal staff have been stitched. up.

I really hope they find other jobs and fast.

We were told that the company was being sold. So we held on. Had I left over a month ago I'm sure I would have got my deposit back. We've been a bit duped.
