UC - split up situation

So my now ex long term partner and I have decided to split. We have a mortgage and two children aged 10 and 7 together.

I don’t want to but it looks like we will have to sell the house as neither of us can afford to buy each other out. It’s a shame as the mortgage is cheap.

We currently claim UC as a couple. We will have to continue to live under the same roof but will live separate lives. Can we each claim UC as two individuals even though the living arrangement is as it is?

You can do long as you live separately - no sharing laundry, food, cooking etc

Best to ring them up directly. And try not to give up your house if you can look at all the options

There is no options with the house. We can’t indefinitely live under the same roof and we can’t afford to buy each other out. It’s crap but that’s the way it is Sad

How much equity do you have in the house ? The problem may be that when the house is sold if both or either of you have over 16k, then any Uc will stop anyway. It can be disregarded as capital if being put into buying another house.

Could you maybe stay there with the kids ( assuming they will mainly live with you ) until they have finished education ? Then the house could be sold.

About £100,000 (£50,000 each) so yes I know once it’s sold I won’t be able to claim UC. I doubt I will be able to go and buy another house as I don’t earn enough. We aren’t in a position where one of us can afford to live elsewhere

You will need to provide proof that you are no longer a couple so stop all bills that are in joint names, stop using g joint bank account etc and set them all back up individually

You could look at shares ownership, you could also look at the person with majority care of the DC staying in the house for a few years whilst options such as increasing salaries, moving to cheaper areas are considered.

Depends on how much you can cooperate.
