I have sold my property and bought into a property with my partner, before doing this I wanted my name on the land registry document , his solicitor advised a deed of trust , which gave us both 50 50 of the property , however now the solicitor has done the deed and registered this with the land registry the land registry document has my partner as sole owner with a covenant that it cannot be sold without my written consent , I’m confused and upset , mainly as my entire life savings built up through the equity of my hone have gone into this new home , if anything were to happen to him I am not an owner of this property , he has said he will contact the solicitor and do what needs to be done to put it right , but I’m also concerned as we want to get a better rate and remortgage adding myself to a new mortgage, so in effect I would have bought half of the property and have half of a mortgage also making my share bigger, what do you advise I should do please?

I would suggest you both see the solicitor together to sort it out

You could also see a solicitor of your own beforehand

I - and probably most people here - are not knowledgeable enough to help directly

Thank you for your reply I have been thinking that’s what I should do and also said that to my partner , I should say that this type of thing is a massive trigger for me

It is potentially a huge deal

Sometimes big things happen which you need to do your 100% best on. Don’t neglect it

Did you give your partner all the money? You effectively bought half the equity, is that right?

If the solicitor was instructed correctly then somewhere there is a mistake or misunderstanding. I suggest you go back to the solicitor. You need to go too, not just send your partner.

Yes we are both going to see the solicitor and I have the paperwork to get the land registry document giving me my share so all is looking good I’m a lot happier about the situation , it’s taught me a valuable lesson to ensure at any stage I’m involved and can ask questions to ensure I’m protected

Next time you need to instruct your OWN solicitor.
