Child maintenance loophole?

My wife has 2 children with her ex, he pays maintenance through CSA. Every year she gets a letter that he has earned £32k, but they’re basing her payments on his £16k salary? Every July they do a review, so the month before he always goes on the sick, sends them wage slips in and that’s where they get the £16k from, then he goes back to work doing all the overtime. How is this possible? Why don’t they look at the year overall?

My ex pays CSA, they use the annual income his employer puts to hmrc

They look at my husbands annual tax return on homecoming system which includes self employed income and his PAYE and calculate his pay for DSC on this. Definitely not on pay slips

So how does he get away with the calculations being done on £16k when it’s been proven for the past 3 years it’s been double that?

We get a letter every July when the upcoming years payments are worked out. Past 3 years his earnings have been £31k “but we are basing the calculations on £16k” 3 years in a row what he has earned has been nearly double, they’re the ones that are telling us this

Ask for a mandatory reconsideration of the decision. If you are still not happy after it’s looked at again you can appeal.
