Employment tribunal coming up!

Dh has received a written version of his ex employers' version of his (unfair!) dismissal, from the employment tribunal; it's all a pack of lies, of course! He's been allocated a day at the tribunal. What should he be doing now?

Discussing it with his solicitor? Or is he representing himself?

If he was in a Union, talking to the union advisor.
Otherwise getting the opinion of a solicitor. If you don't have one, then go to the CAB who should be able to point you in the right direction.

you could be me (or your dh could be)..

I got my employer's version last week and he's having to rewrite it..

Left employer in June, have seen a lawyer who does voluntary work for the CAB and he helped pushed my case forward; gave an honest opinion on whether he thought I had a case....it was very worthwhile..

Mycase takes place on 14th December 2004 and I am going with dh but no representative..

best advice I could give you would be to contact your CAB immediately and ask to make an appointment..

Whoever deals with this will ask you to type out a version of events (your story) leading up to the dismissal...and then they tell you the best thing to do next..

Please e-mail me if you like as having been dealing with this on and off for nearly 4 months and know a little..

ACAS which is an organisation should be in touch with your dh soon, they are a mediator and can help communicate between the two of them....ie. once the employers and employees events have reached the tribunal court ACAS normally gets in touch by a letter...it is well worth using their services...they are free.

He should also contact the Free Representation Unit (trainee barristers take on the case) but not rely on this as his case may not be taken on (although it may be worth ringing them to find out what the book they all refer to for employment tribunal preparation is called - I can't remember the name of it but it is really good). Meanwhile if he has no representation he needs to start preparing his case - his side of the story + go through the empoloyer's side point by point. If I remember correctly he'll get to call witnesses and cross-examine his employer so he needs to prepare his case thoroughly as he'll need to present his case clearly and methodically. So, start listing out the points your husband needs to make to make his case and to refute his employer's case + get together all the evidence (letters etc) he is going to present (+ copies for the other side and the members of the panel.

Thanks for your replies. He has now contacted the local CAB, so should be able to see someone there either this week or next. Tinker, he hadn't even got as far as that decision yet! Unfortunately he wasn't in a union, and though he has been in touch with ACAS, the particular person who is meant to be mediating seems quite elusive at times! The Free Representation Unit sounds like it could be worth a try....any ideas on how to contact them? I have no idea where to start! Lavender, I'm in awe! We had a quick read through the papers sent through by the tribunal (child allowing minutes here and there, so far!) and at first glance it's difficult to make out exactly what DH would be expected to do if he does go ahead and represent himself. What has to be presented before hand, dates to adhere to and whatnot! I may well contact you, thank you very much for the offer . Best of luck for your hearing.
