Tax credit disregard income on MA / SMP?

Does anyone know the rules around disregarding income for tax credit claims when you receive MA or SMP? Some site say disregard £100 a week and others disregard anything above £100

I think the disregard is different depending whether it maternity allowance or SMP you are getting.

Although I think that may be for Universal Credit rather than tax credits.

This is the eligibility criteria. Do you meet the criteria for SMP?

Statutory Maternity Pay (SMP)

To qualify forSMPyou must:

  • earn on average at least £120 a week
  • give thecorrect notice
  • giveproof you’re pregnant
  • have worked for your employercontinuouslyfor at least 26 weeks continuing into the ‘qualifying week’ - the 15th week before the expected week of childbirth

If you usually earn an average of £120 or more a week, and you only earned less in some weeks because you were paid but not working (‘on furlough’) under the Coronavirus Job Retention Scheme, you may still be eligible.

I had time off due to covid where i did not recieve furlough etc this is why i am unsure. Waiting on a decision.

What weeks of pregnancy were you off?
It's roughly weeks 17-25 that they use to determine your maternity pay (or the 2 pay slips prior to the 25th week of pregnancy) Did you get sick pay?

THATbasicSNOWFLAKE · 16/04/2021 15:21

No sick pay and within the qualifying period

Did they not pay you anything?

dementedpixie · 16/04/2021 15:24

Or was it due to isolating for a child and unpaid?

Does it take your wage below the £120 average?

Tax credits ignore the first £100 of SMP, they ignore the full amount of MA as it is not taxable income.
