How to protect pre-marital assets when it is a marital home?

A couple is getting married and moving into a house owned outright by person A. Is there any paperwork that A can do so their spouse wouldn't be entitled to the property?

But my understanding would be that anything you draw up pre-marriage will not necessarily be enforceable in the event if a subsequent divorce. Whether the judge allows any agreement to stand at that point will depend on length of marriage (e.g. if you split within 3 years vs 15 years), whether there are children to consider, contributions to the marriage via childcare and effect on career etc.

So don’t get married if you’re not up for ‘all that I have, I share with you’, basically.

In the right circumstances pre nuptial agreements can work - seeing a solicitor to get one drawn up would be a good call. You will need to ask for advice specifically around protecting the marital home.

Get legal advice first.

Prenups are not legally enforceable in the U.K.

I know someone who got the other party to sign a document from her lawyer saying that the address of xxx was not the marital home. But that was in Scots law and may no longer be legal and may not be legal at all outside Scotland!

Defo legal advice prior.

They can be enforceable according to the link:

“question we come across is ‘are prenuptial agreements enforceable in the UK?’, or to put it more accurately, ‘are prenuptial agreements legally binding in the UK?’.
A prenuptial agreement in the UK is not automatically legally binding but will be upheld by a court so long as it meets the qualifying criteria, which have been set by the Supreme Court and further reviewed by the Law Commission”

Thank you for the responses. I had missed the legal board on this site. Also, yes for legal advice beforehand. Just figured I'd do some investigation beforehand. There are big things and defining factors if marriage is the best option :)

I was aware of the pre-nup not necessarily being enforcable but I was wondering if there was something else to look into. I'm also wondering if it would be an option to sell and then own unequal shares or ring fencing or a deed of trust but it seems that in marriage they are considered case by case basis (?).
