Divorce _ Finances Form E

Hi.
Just a quick question. I'm at a stage of finance split, in divorce, Form Es have been exchanged 2 weeks back.i have provided 12 months bank statements and everything else asked of me.
We want to settle finances out of court voluntarily.
Today my husbands solicitor has asked my solicitor for previous 5 years bank statements.

Can they do that?
Is that a legal requirement?
And why did they ask about it?

Plz help.

They can ask for whatever they want. Doesn't mean you have to give it. Like the PP said, have you inherited or won any money in the last 5 years, if not then just give them 12 months worth of statements.

Thank you so much. I have not inherited or won any money at all ever, apart from a tenner in a national lottery 17 years ago.

I'm actually trying to avoid the court proceedings. As they take so long and cost alot of money.

Since 2015, after a DV , I am a single mother who has built her whole life again with a child in a new city, and let H reside in the family home since 2015.
I moved out and away 4 hours.

Last year I had 2 massive heart attacks and have 2 stents put in. Doctors have told me to stay away from stress.

The divorce is in courts. I'm waiting for decree nisi, in a week or two.

Now the finance split is upon me.

I'm working part time now and on universal credit. I want to avoid court fees.

Can someone please help and tell me any alternative to court proceedings.
May be explain mediation process or the likes.

Do you think, its wise to contact my husband, on text or phone and ask him to save ourselves from stress by settling out of court.

Please advise.

I'm in a very stressful situation.

If there was DV, can he talk nicely & respectfully to you?

I think it might be less stress to rustle up 5 yrs of bank statements & send them off & see what is said next. Your stbXH asked coz obviously looking for some kind of way to pay you less £.

Mediation is supposed to cost less than going thru solictors; but the whole thing is very expensive & time-consuming unless you are very lucky to get a truly amicable split (rare).

I think you can get yearly statements so that's just 5 pieces of paper. Amount at start of the year and amount at the end.

Urgh! It’s supposed to be 12 months. Unless there is something he thinks you’re hiding - has a close family member died, for example and he’s assuming you have an inheritance? Either that or he’s looking to prove how utterly wasteful you are a d how you don’t need a y kind of settlement. Or, most likely, he’s just being nosey.

  1. As it's been nearly 5 and a half years since the DV and the seperation, he has calmed down a bit, and hes better on the phone than in person.
  1. His own dad passed away December 2019, and left him with a house and cash.
Hes probably asking for 5 years to see if his dad had helped me financially or if he left me anything. But there wasnt anything left for me anyways.
  1. I can provide his solicitors with the 5 years bank statements providing they do the same.
  1. I just got to know, that Decree Nisi s paperwork arrived today.
