Consumer rights - faulty new car.

My sister took delivery of her new car from a local well established car dealership at the end of May. Within 2 weeks it developed a fault and had to go back to the workshop. They kept it for several weeks but did supply her with a courtesy car. She had it back for a couple of weeks and it was recalled from teh manufacturers. It was repaired and given back to her. Now it has developed a vibration fault and has switched itself to "limp" mode - juddering and spluttering and generally not suitable to drive. She has asked for them to replace the car as she now has no confidence in it. They have said there isnt another one identical in the country and have offered to build her a "57" plate as they cant supply an "07" but want her to pay extra for it. She doesnt want to do this. Where does she stand?

also the new car wont be ready until xmas and they want her current car so they can fix it and sell it on within the next few days to minimise their loss! Thereby out of 7 months she will be without her car for 13 weeks

Wish i new the answer but that cant be right

can she not reject the car as 'not fit for purpose' and demand the £ back...

then go to another dealer and get a completely different car?

Probably best to contact her local Trading Standards office - they can give legal advice for free and/or negotiate with the garage for her if she doesn't feel confident in doing this herself.

Hi, I used to work in the motor trade and if I was her I would just ask for my money back....the car is faulty and if they cannot replace it then they have to give you your money back.....maybe better going to another dealer.

Also, what kind of car is it that there is not another one identical? I do not believe that they cannot source another one.

Just mention the Sale of Goods Act to them and they should know that if they cannot replace then they have to give you your money back.

its a bmw 325i convertible which is a new model apparently but the colour is unusual .....................................................its silver

I think they are having a laugh. If I were her I would demand my money back as the car is faulty. She is perfectly entitled to do this.

Silver? Gosh there are not many cars that colour on the road!!

she;s negotiated with them that for £450 she gets the brand new 57 plate and they will provide a decent car for her to jolly around in until it arrives at xmas.

I would not be happy (and would not agree to it) but if shes happy i guess thats what matters
