Don’t hate at me please I need serious advice. So basically broke up with my husband of 14 years I won’t go into detail here as there’s no need. I need some serious advice regarding what to do financially. He earns a basic of 65k and after commission it’s more like 100k but this year it’s been more like 65 due to corona. We have four kids two under 5. We own our home mortgaged but with 100k in it. I haven’t worked in ten years. Wtf do I do? Do I get 50% of the money we have in the property or more? Can I claim benefits until the younger kids are at school and I can work? Would he pay me child maintenance? I have so many questions and no answers 😔

I did an entitled to calc and put in a figure as if I was to rent a house but I’m not sure if that figure includes help with my rent or not?

If you claim Universal credit then you would be able to claim a rent element as long as the maritial home is on the market, so they will not count it for a while if you are taking steps to sell it. If, once the house is sold you have more than 16k equity from it then you won't be able to claim UC. If you are putting that equity straight into buying another property then it can be disregarded as capital. You really need to speak to you husband and decide what is happening with the house, does he want to stay in it, will it be sold, could you stay there until the children are older ? If you do claim UC then even if you weren't eligible for the rent element then you would still get standard and child elements and to be honest with him earning that amount you are going to be getting a good chunk of child maintenance so should have enough to live off.

I should just add as there is a 2 child cap on Universal credit you would not get child element for any child born after April 6th 2017. So if the youngest was born after that, you would just get 3 x child elements.

There is a divorce/separation section, you may get more responses on there.

You need to try and stay in the house until the youngest child is 18....you can use the time to save up money....retrain and get a good job etc.
He will have a charge put on the house to protect his interest.
