Marriage Allowance

Hi All
I'm pregnant and looking at if I'm eligible for marriage allowance (transferring some of my tax-free allowance to my partner). Apparently to be eligible the partner who earns less (me) needs to make less than £12,500/year and the person who earns more (husband) needs to earn less than £50,000/year. I have 2 questions:

  1. Does Statutory maternity pay count as income? I.e. does it count towards the £12500 limit that I can earn in 1 year?
  2. Can I still get marriage allowance if my husband earns £51000/year?

Statutory maternity pay counts as income, it is paid by employer and taxable.

Yes & No.

However you can go back 3 or 4 yrs so may have been eligible at some point.

If your DH earns more than 50k he is in higher rate tax bracket which is the reason you can’t transfer the allowance.

The person that earns more needs to earn less than £50,000....

Thanks for the replies, this is really helpful. My husband currently earns just under £50k but I reckon in April he might be bumped up to earning just over £50k, I'll have to see!
