I've bought a bnib makeup bundle on ebay, seller has good reviews. It's arrived and its ALL fake. These are branded high end items too, I did get a decent deal but didn't pay a ridiculously low price which is why I didn't think it would be fake. I have contacted the seller and they said it says in the description - which it does say 'I'm not sure if these items are genuine as they were given to me by a friend as a gift'. Does anyone know Ebay's policy in this instance - they shouldn't have been selling it anyway if it's counterfeit surely regardless of whether they said it was possibly fake in the description? What will happen if I raise this with ebay? They are also still selling more bundles so imagine these will be fake too. I can't wear it as I don't know if it's even safe so the whole lot will have to go in the bin!

You can raise with trading standards too who investigate repeat offenders.

Surely if they are selling multiple bundles given as an unwanted gift that Indicates they know full well they are counterfeit. Is that enough fir eBay to go back on?

Just do a not as described case and out counterfeit - state that the OP acknowledged thay they were counterfeit (dont use fake) in a message. Ebay will give you a full refund

Happened to me with some ugg boots years ago. Opened a case, the item is counterfeit and it’s illegal for her to have sold it to you. You shouldn’t have to check listing to see if it’s genuine as you shouldn’t be expecting to be sold an item on their platform.

I believe PayPal tried to tell me to return the boots to her for a refund, I refused and reminded them I would be committing a crime by posting counterfeit goods and they couldn’t legally ask that of me. They refunded immediately after that.

I was pissed off she sold me fakes and wasn’t willing to let her have them back to sell again. Got my money back and binned them. They were tragically bad fakes and she had used a photo of genuine (but not the actual ones she sent me) boots on her listing.

Definitely wouldn’t recommend using any of it. Counterfeit makeup is often full of really gross stuff, sometimes dangerous. Don’t risk it. Though I’m sure you wernt going to anywsy.

Open a case saying their counterfeit. Counterfeit goods aren’t allowed on ebay even if seller has used an “I’m not sure if they’re genuine” disclaimer.

I’d also report all their other listings of counterfeit goods so they can be taken down by ebay.

eBay should give you a full refund.

@bimbleboo exactly what I thought re she shouldn't have been selling it in the first place, I didn't read the description because I didn't need to, if it was real I would have had no issues as I could see the items included in the pictures (couldn't tell it was counterfeit from the pictures but I can in real life). It's so frustrating isn't it, I'm a big makeup collector so know how dangerous fake makeup can be, it's definitely not something I'd ever risk. Could have anything in! @Thefirsttime Thank you, I've opened a claim with Ebay now just waiting for them to get back to me :)

eBay should arrange for you to be refunded and tell you to throw the items away, they should not tell you to return the items to the sender if they’re counterfeit.

I’ve just noticed the terrible grammatical error in my last post of “their counterfeit” which should say they’re counterfeit. I’m usually a grammar pedant so this upsets me greatly!

Thanks all, ebay have refunded and advised I don't need to return them! I'm still not going to keep them but at least I don't have to go to the post office in the pouring rain Grin

On the back of this I've actually received another counterfeit item (I clearly buy a lot of make up on Ebay 😂) . On receiving it it's obvious that it's fake but the pictures must not have been theirs. I opened a not as described (doesn't seem authentic) case and included pictures from the official website vs the one I've got along with all the ridiculous spelling mistakes and the fact the shades aren't even the same - but they have come back to me and said I MUST return the item before they will give a refund. I want to just get rid of it and have my money back, to be honest they could collect it if they really need it back I have no idea where in the country they are but I'm not comfortable shipping counterfeit goods?! Is there anything I can do about this? Will ebay side with me if I take it further? I return items all the time if they're not right and have barely ever opened a case with ebay, only these 2 times for this reason!
