Due to a large overpayment a couple of years ago our ctc has been stopped to pay back the money. We are going to really struggle now. What would happen if we applied for uc? Would we get anything or what they also not pay due to is oweing hmrc?

If you applied for Uc now, your tax credit claim would end but you would still have to pay back the overpayment from your Uc unless you can negotiate lower repayments maybe.

You are entitled to up to 2 years to repay. Longer if it goes to the collections dept..
Look up tax credit repayment via Google.

Yes i know i would still have to pay it back, im asking would uc take my whole entitlement to pay it back or would they just take some money off monthly to pay it back?

Isn't it only a change of circumstances that triggers uc change over? Not sure you can just request it instead of tc.. I was overpaid as a single claimant when I submitted a joint one. Still repaying it over 5 years later at a minimal amount..

They would just take some money off for repayments but obviously it would depend how much your Uc entitlement would be in in the first place.

Anyone can switch to UC at any time if they want to. Many people are better off on Uc especially if you have rent to pay and can't make a new claim for HB.

It might be worth contact Tax Credits people as they may be to adjust the amount you are repaying, or your claim amount may go up if you've had a change in circumstances.
