Nhs scotland maternity pay

hello,

Looking to see if anyone has been in a similar position and can give me some advice.

I am currently pregnant, very early on. I worked for an NHS scotland Trust for 3 years prior to moving to a different nhs trust in June. I didnt have a break in service, finished with old trust on the Friday and started with new one on the Monday.

I am wondering about nhs occupational maternity pay.
It states that you have to work for the nhs for 1 year 11 weeks before your due date. I will not have been with new trust for that amount of time but my understanding was that it is for the nhs as a whole and not trust specific.
I spoke to HR at new trust this morning and they say I am not eligible, but after doing some online research I dont think this is right and I am eligible.

Has this has happened to anyone else? thanks.

I'm not sure that's correct either. Doctors move to different jobs and trusts several times as their career progresses and they maintain all rights to maternity pay. I would challenge it

No definitely not right. You’re entitled to OMP if you’ve had 12m continuous service with one or more NHS employers at the beginning of 11th week before due date.

If you google agenda for change terms and conditions of service handbook and look at “section 15: leave and pay for new parents (England, Wales and Scotland)” it’s all there.

Send them a copy of the handbook!

You should also have your Trust’s policy which should mirror it.

Mine was in England but I moved trusts just prior to getting pregnant and was entitled to NHS pay

Your continuous service starts with the day you started in the NHS - not the current health board.

Sometimes when you speak to HR, you get someone relatively junior (or an admin type person) who doesn't know what they are talking about.
