Legal aid - can they do this? help!

They're as bad as the CSA for getting things wrong IME.

They did this to dh. He was originally told that he had to pay x amount per month towards to costs, appealed and then had a letter saying his costs would be paid. About a year later he had a letter from them saying he owed them thousands. They denied ever sending the last letter, so we had to copy everything and send it off to them. We waited to hear but have heard nothing since and that was about 7 years ago.

Have you still got all the correspondence?

Yes, we'd moved too and had a lot of hunting around to do. For once I was pleased I'm a bit of a hoarder.

What about your solicitor, I think they get copies of the correspondence. Maybe they can help.

Hi, when you got divorced did you make any kind of financial recovery, ie a share of the house, pensions, capital sum etc? Also, I think the way legal aid works in Scotland and England are different. Do you live in England?

I think the way it works is if you have had any kind of financial settlement/payment as a result of your divorce, then you have to pay this back (if you have received help)

It's sometimes referred to as 'clawback' - the reasoning being is that the money you received in way of help is public funds and therefore if you get any kind of settlement from your separation/divorce then you have to pay this back......your lawyer should be telling you this.
