Refund after chargeback

Hi, mum had a refund after chargeback from a holiday earlier in the year. Getting through to the holiday company was impossible so after waiting months, she did a chargeback (or section 75 not sure).
She provided evidence to her bank that the company should have refunded after cancelling her holiday. The money was refunded back the next day by her bank. A few months later she received an email asking for her to fill out an online form to receive her deposit back. She assumed a scam email and deleted. On checking her account online a few weeks later, she saw she has been refunded by the company as well aside from the deposit.
Her bank say the 45 days is passed. Getting through to the holiday company is still an arduous task. We assume this amount will be given back to them in due course but the bank were vague. What she doesn’t want to do is not pay her credit card in the meantime, however she is now in credit so can’t.
Has anyone advice? I thought perhaps she could move it to savings do she keeps on top of the cc and pay when they notice the error. Would this be ok or could she get into trouble?

I'm not sure i understand. Do you mean she has has 2 refunds now?

Yes. She had a full refund from the bank, I assume they chase for the payment. Then most of the original amount refunded by holiday company.

So yes, 2 refunds aside from deposit on second. She assumed this would just get reversed but she’s been on credit for a month now.

Your post is confusing.

I think you've said your mum has received her full refund via the chargeback, and the full refund less the deposit from the holiday company?

If so she needs to contact the bank and ask what to do.

You said she's worried about not paying her credit card. If the balance is in credit there wont be a payment to make.

Sorry it’s a confusing op.
The bank have said the company have 45 days to dispute a chargeback. It’s been longer now. They had no other advice on the phone or in the branch. I can’t imagine she’s the first person to have this occur.
At the moment she is in credit whilst the refund from holiday is on there. So she wouldn’t be at risk of a problem on her cc from not paying her regular payment? Sorry it’s confusing!

As she's in credit any purchases will just be reducing the credit card balance. Is it the credit card number she is contacting as they will be separate from the High Street bank branch

If she's in credit a payment won't be requested.

Given that the company has 45 days to dispute a chargeback and they haven't, your mum can contact the holiday company and let them know they have made a duplicate refund to her in error so she can return that to them (they'll need to charge her card to deduct it from thw CC balance).

The money needs to go back to the bank, not the holiday company. Your mum keeps the money from the holiday company, as she's entitled to it.

Your mother needs to tell the bank that the company have now rectified the issue, given her the refund and then the bank takes their money back.

Its not the holiday company that gets the money, its the credit card as the credit card refunded without getting the money from the holiday company first.

I had a similar situation. I got a credit card refund. Then the company that had messed me around eventually sent a payment to my bank. Phoned CC provider to return their payment and they said as they had gone through the procedure for a refund I had to keep it. PITA company couldn't take it back either so I had a nice bonus of £1000. Honesty can pay!

Wow, a nice £1k gift is fab for your honesty.
Spoke to mum, she called her bank again who are saying the company had 45 days to dispute it which they didn’t. Not suprised, they are snowed under with refunds/complaints etc. Bank not interested which is also mad.

It should eventually disappear on it's own. I had to do a chargeback for a hotel stay, as Love Holidays didn't refund and were uncontactable. About 10 days after the bank refunded it, so did Love Holidays. I just let it sit there, and about 4-6 weeks later the extra was taken back by the bank. I think they are so innundated it just takes a while for their systems to catch up!

Thanks! I assumed it would get whooshed away, she was just worried that she couldn’t pay her normal bill on the valid purchases whilst this big credit sat there.

Just a quick update. She had a text from the bank to say they were taking back the duplicate, they had paid her the chargeback so they get the money. Or something along those lines.
