Im just really looking for some advice as it all fells very odd.

I had a house fire back in 2018, the cause of the fire was my hot water tank/timer overheating and catching on fire. A month before i had an engineer from a large energy company come out to do a temporary fix, i paid them monthly to service my appliances.

Long story short im now going through the motions of suing them. They have admitted liability.

In terms of damages. It was me and my 5 year old in the house when the fire started, luckily the fire alarm alerted me to it and i was able to grab her from her room and get out but the fire had already spread to the top of her door frame so i was very lucky to get to her. So there was no physical damage to us "just" psychological. The year after the fire in all honesty was hell, so much to go into on here.

But now the claim has been valued at around 10k as a "low value claim" and i just feel so so wronged by it. We basically lost a year of our lives as it was putting our lives back together after not to mention the atrocious experience with builders we had to repair house. (Cost covered by buildings insurance)

This was our first home we owned (single parent) and to be honest its been ruined ever since, just cant quite afford to move just yet.

I hear of people getting that amount for whiplash claims in car accidents it just seems like peanuts for what we actually went through. The solicitor is earning a whopping 80k for this so it also feels not in their interest to fight for more for me as Theyre getting that regardless.

:-(

Thanks, any advice appreciated

Caveat I am a criminal barrister.
What is your cause of
Action ? Is it Personal Injury (Psychological) and/or some kind of breach or negligence against the energy company.

Your solicitor should be the one to explain why it has been assessed at 10k. There are all sorts of things which can reduce a claim - remoteness / unforseeability of some damages / failure to mitigate loss. These may be jargon to you (And May not even be relevant to your circs) but your solicitor will/should have set it out so you understand. Was there an expert and did you see any report assessing damage and loss?
It’s honestly difficult for anyone without knowing your circs and seeing all of the docs (and being in that area - which I am not) to be able to hazard a view. As you have solicitor instructed it also becomes difficult to advise you as well.

Drop your solicitor a mail or call to ask for bullet point explanation of how 10k was reached.

Really sorry to hear what you went through - well done for some level headed was in am emergency and thank god neither of you were Injured physically.

Good luck op.

Have you seen a medical expert? Have they prepared a report on your injuries? What about your child?

Have you compiled a full list of all of your financial expenses resulting from the fire?

You are only entitled to compensation sufficient to put you back in the position you would have been had the accident not occurred so you need to be able to evidence damage or loss in order to claim for it.

Where did you get the information that your solicitor is getting £80k for the claim? Personal injury costs are on a scale now so they wouldn't get that for a £10k claim.

I don't understand how your solicitor is getting that much for a £10k claim. Who employed them? I thought they got something like 20% or whatever of the final settlement, not 90%.
