I have a DS with SN. He will probably never be independent. He will probably always be dependent on benefits. Possibly me too as his carer.

"D"P would like to give some money now to help support DC in the future. They cant give it directly to me else it will mess with my benefits so are proposing giving it to a sibling to look after for me.

Background DP and I had a massive falling out less than a year ago. Whilst we are back on reasonable terms I am wary.

My will sets up a trust on my death to support DS (and DD) in perpetuity. I'm wondering if we can establish it now.

Anyone set up a family trust? How hard is it to set up and run?

I assume DP are your parents, not your partner?

How old is Dc? If still a minor you could put it in a child savings account in their name, maybe? Some have good rates. And then, with power of attorney or deputy ship (if they do not have capacity) put in trust when they are older?

But I don’t know how a child’s savings affect anything.

Yes DP is darling parents.

Trust fund no good as theoretically DS can access it at 18 so messes up his benefits then.

You need a discretionary trust, try mencap for advice.
