Will writing - specifically disabled trust

This is something I should have already done Blush

I am a lone parent with 2 DDs. DD1 is an adult with disabilities meaning she is highly unlikely to ever live independently without support, or manage full time employment. She receives enhanced PIP both components, and the highest rate Universal Credit. Obviously I know if anything happens to me and she inherits, she’ll lose her UC.

I have been looking into setting up a trust for her in the event of my death (there is very limited family support) as I would like her to have enough to be able to buy her own house near her support network - which is currently 300 miles away. Without a trust I think she would fall foul of the deprivation of capital rules should she buy a house out of any inheritance.

I know I need legal advice, but the cost of this being suggested online is very prohibitive, so I’m asking if anyone knows of where I can go to for help in setting this up please, without it costing me money I simply don’t have?

The Trust would be a Will Trust, but be a disability trust and any solicitor that does private client work can set this up. I would expect to pay about £600

Looks like Mencap has a lot of info on its website, plus some phone nos for advice - might be worth a look?

"Bristol" that's cheaper than I found, but still a lot more than I can afford Sad

"Ancient" thanks, I'll have a look at Mencap.

It shouldn't cost quite that much. As a benchmark, I charge £300 for a single Will incorporating a disabled person's trust, but I work from home, so high street practices will always have to charge more to cover their overheads.

It’s a discretionary trust and any will writer or solicitor that specialises in wills should be able to help.

Me and DH have had to do our wills this way for similar reasons. We paid just over £500.

That’s good. @TeslaGirls give Mumblechum0 a PM.

TeslaGirls · 28/04/2020 20:11

Thanks guys, @Mumblechum0 do you mind if I pm you?
