PIP affecting UC

Dionne1707 · 26/04/2020 09:10

We have made a UC claim due to DH being furloughed but under ‘other income’ they have deducted £605.60 which is the exact amount of our DS (19) PIP. Surely this can’t be right? I have looked online and it says PIP doesn’t affect UC but they’ve deducted it...can anyone help?

Is it coming into your bank account? I don't think PIP should affect UC but if it's paid to you they may have incorrectly identified it as income.

Dionne1707 · 26/04/2020 09:19

Yes it’s paid to me as I’m his nominated person, can’t think of the correct term the use for it. I pay it to him as and when he needs it or wants to make a big purchase etc. I’ll call them tomorrow but just panicking at the minute as it’s a huge chunk of money to lose.

You are your DS's appointee. PIP does not affect UC however it looks like some information has ended up in the wrong box.

YorkshirePud1 · 26/04/2020 09:30

This sounds like a mistake - if you submitted your bank statements they might have incorrectly counted it as other income possibly? There's no non-dependant deduction for someone who's receiving the daily living component of PIP (even if there was it wouldn't be for the full amount). I think it's an error on their part which they should fix for you when you call them hopefully.

Babyroobs · 26/04/2020 12:30

That amount is the exact amount for 4 weeks worth of PIP at enhanced rates for both components so sounds like a mistake. Just ring them and explain what has happened and that you are your son's appointee and why it is paid to you.

If your ds is no longer in education he can also have his own Uc claim.

Dionne1707 · 26/04/2020 12:40

Thanks all, definitely seems like they messed up.
Appointee is the word I was looking for.
Hopefully they sort it tomorrow as my first payment is dues Saturday!

Maybe they are counting it as household income. But even so if PIP doesn't affect a UC claim then it shouldn't be counted.

@OP, as per pp's advice, you can make a UC claim for your 19 year old DC in his own right.

The DWP may make you apply for a separate appointeeship. Yes, I know it's crazy, given that the DWP run PIP and the DWP run UC, but that's what they did to my DP. He ended up with two identical pieces of paper, with the same reference code in the corner, just with different dates on them. Go figure.

We ended up effectively rewriting the PIP2 form onto the separate UC50 form, enclosing copies of all the original supporting paperwork and reports, in order for his DS to be placed in the UC 'support group' (no requirement to work or look for work), as the UC dept don't and won't take into account any PIP award, even if the person is on both enhanced elements.

You then have to ask UC to apply any relevant disability premium, as this may not be done otherwise.

It is a system not fit for purpose; but I hope our experience might help others Flowers

Oh and btw, UC doesn't deduct PIP, but it does shamefully deduct Carer's Allowance (that massive £67 a week for 35+ hours of care a week).

So your deduction could possibly equate to 9 weeks of Carer's Allowance (5 weeks in arrears, 4 weeks going forward).

Dionne1707 · 26/04/2020 22:02

It’s definitely 4 weeks enhanced rates of PIP as it’s the exact amount. After everything is straightened around I’ll look into DS claiming in his own right but he’s still at college until July when his course ends so he’s considered as in education.

@AutumnCrow there’s a section where Carers Allowance is deducted and it’s 4 weeks money, tight sods!

Hi @Dionne1707. I'm a work coach. I think you should send a journal message to 'payments' asking for a mandatory reconsideration. It sounds like you've included PIP in your 'other income'. When they ask what other income you have, it should have been clear that you don't include PIP x
