I was watching Martin Lewis last night and he had a car sales employee phone in/face-time and ask how much he should be receiving from his employer through the furlough scheme.
The term 'contractual commission' was used which I think meant if it's in your contract to earn commission at X amount on top of your basic pay, you should be paid this too and not just paid 80% of your basic pay. I've done a basic google search and it does say on one website...
*''If you receive a regular salary, the 80 per cent should be calculated based on an employee’s actual salary before tax (their gross salary), as of March 19.
If your pay varies (because you are on a zero hours contract or flexible working contract, for example), the 80 per cent limit will be applied to the same month’s earnings from a previous year, the average monthly earnings for the 2019/20 tax year or an average of their monthly earnings since they started work – whichever is highest''.*
I am asking this question as my ex (who is a salesman earning commission on top of a basic wage) has just paid me half of the monthly maintenance for our ds saying that he's only being paid his basic pay under the scheme so this is all he can afford. I have no way of knowing whether this is true... does anyone else know any more about this please as after reading the above, his employer can claim for his 'usual' wage under the outline above either by an average or looking back to February's pay. I too have been furloughed and I work Part-time and rely heavily on the maintenance for our ds. Obviously now as schools are closed outgoings are higher where children are concerned. Any information on this would be much appreciated.
Thanks in advance.
