Inheritance tax refund

Hello,

My father died and his house was estimated to be worth a certain price.
It sold for less than what it was estimated to be.

We are now due a refund of 6000 pounds in inheritance tax.

The issue is that the executor is my uncle. Myself and my uncle have fallen out prior to this.

The solicitor said that the paperwork must be signed by my uncle, before he can put the claim in for a refund.

He sent the paperwork to my uncle five months ago and he hasn't sent it back. The solicitor reminded him a few weeks ago, and he still hasnt sent it back.

I know he is doing this because of our falling out.

What can I do in this case, if the executor won't sign the paperwork?

Your solicitor needs to write again to the executor reminding him of his legal duties. Also that if he does not sign the form the solicitor can arrange to have him removed as the executor by the court for not fulfilling his duties. Pointing out that the uncle could be found liable for the expenses involved in all of this as the situation is his doing.
