Does UC affect maintenance payments for paying parent?

My partner is now on my UC claim and we should get about £600 (probably just the child element) a month, will he need to tell cms of this extra money-even though it's for my kids?

If the paying parent has an earned income, maintenance payments will be:

worked out from that income - Universal Credit won’t be included in the calculation
collected directly - they won’t be deducted from Universal Credit payments

As per above, the CMS figure is based on your partners earnings alone.

I assume he is now living with you and your kids? If he has not done already, he can tell CMS about the new living arrangement. As he is now living with other children this will reduce the maintenance payments he will have to make (as CMS assumes he will be supporting their costs)

Ok thank you for that. We know he can reduce his payments if he tells cms but hes going to see if we can afford to keep the current agreement first. I just didnt want him having to pay more because of the UCs. Thanks

Another question I've just thought of, though I think I know the answer. When do puts his earnings in for uc, can he deduct the child maintenance payments he pays? Or is it whole earnings? I'm thinking whole, though it's a bit crap as it's over £300 of "dead" money.

Are you seriously calling his financial contribution towards his own children ‘dead money’?? Of course the whole income is included.

No of course not, like I said we're not telling cms he now has 3 more dependants so that his maintenance payments are reduced. However it's not really income we can spend so thought we could maybe take it off the UC figure. I'd never begrudge his children money.

Paying maintenance is the equivalent of him spending that money on his children though, so it is income that is spent.

He doesn’t have 3 more dependents though. Damn right he shouldn’t be reducing his CMS, whatever the ridiculous and morally abhorrent rule on it allows.

Would you really want a boyfriend who just cuts his support for his own kids? Seriously? He shouldn’t be “seeing” anything. He knows what he should pay, and he should pay it. Or he’s an arsehole. He’s looking that way just for his “seeing” Hmm

Maintenance payments cannot be deducted from earned income for UC purposes.
UC will go by his net income (after tax , NI and pension contributions).
