Time for a new Fred, huns. We watch bots (people who have signed up to multi level marketing schemes which are thinly veiled pyramid schemes). We expose their lies, in the hope that fewer vulnerable people will be sucked in to buying a fake business. This is not trolling. It's calling them out on their fakery. Welcome, huns.

Some non competition restrictions in contracts between peopole who are not employees and those who pay them are reasonable and valid under English law. it is a bit of a muyth that they are all void. I put one in a contract yesterday. it will depend on the case. That alone does not make someone an employee but I agree it is a piece of evidence that might help to tip the balance in some cases.

IR35 and the new rules under it in force in April does not apply to sole traders like I am but instead to limited companies so again it will depend. If I do work for anyone IR35 does not apply and the usual test of whether I am an employee or not is used (I am not anyone's employees and nor would a local plumber who goes out to different customers every day etc). If instead I or the plumber had our own limited company then IR35 would apply and have implications including a burden of proof from April in large customers having to risk paying employer NI if they are really taking the company/person on in an employee type relationship.

That's correct @Xenia.
The usual test for restraint of trade is for 'reasonableness'. Blanket restrictions almost automatically fall foul of this.

Most bots are sole traders (if they even bother to register), so the implications are more in terms of whether they fall under IR 35, rather than an unfair restriction of trade as such.

The more senior bots have set up limited companies to handle their biznis, but I believe any contract with FLP is between the bot as an individual 'distributor/FBO' rather than as a representative of the company- can anyone confirm how this works?

IR 35 does not apply to sole traders.However the existing law on who is an empoloyee and who is not which has been around for at least 50 years does apply and will determine if someone self employed is an employee or not.

Yawn’s Director’s Loan (all £205,180 of it) is interest free with no fixed terms of repayment. There will be a big fat tax bill to pay on it though.

Ooh Yawn has called out Homeschool with a "wanker move" comment on her status. It appears Homeschool has replied to a message from one of Yawn's "stars" (think bad jeans at success day) with a cryptic comment about leaving FL and "find out what's next". Yawn's bot messaged Homeschool for help with FL in April and she never replied then.......

My guess is her annual income, after expenses, starts with a -

At this point she is likely paying out more than she is earning. Those dog pushchairs are only £40, yet she had to borrow one. A friend got one for her dog who can't walk well, next day amazon delivery.
