UC have said DH is fit for work- he's not and wants to appeal. Any help?

Have NC'd for this.

Had a message in our journal today for DH. It went something along the lines of 'although you've provided us with sick notes and your GP has deemed you unfit for work and you receive PIP, we've decided you're capable for work and you will not receive LCWRA. DH has asked for an appeal. Has anyone appealed in a similar case and won? Feel so deflated right now Sad

Well people do work and claim PIP, so that in itself doesn't make someone unfit to work. An appeal would have to be more specific than claiming PIP, so concentrate on the GP evidence.

@illnever You need to think about exactly what makes him unfit to work. It’s no good saying he has epilepsy/diabetes etc because plenty of people work with that. You need to go into the minutiae of it and why he can’t because of his condition compared to a healthy person.

Are they saying he isn’t fit for work though because that’s not the same as not being fit for work related activity.

Do you think that he's incapable of doing his current line of work, or that he's incapable of any work and any work related activity?

LCWRA group is for people so ill or disabled that they are deemed unsuitable for even preparing for a return to work.

LCW group is for people who may be able to return to work at some point, with preparation.

Do you mean you have asked for a Mandatory Consideration? Or have you already done that and are appealing?

Either way, for a decision to be overturned, you need to provide extra evidence. Just asking them to reconsider if they haven't anything extra to consider is very unlikely to succeed. It really depends on how he's restricted. Is he under a consultant for the condition? A consultants letter in support would help. Failing that, a letter from his GP?

Any documents/letters can be scanned to the Service Centre from the Jobcentre
