Financial Assessment for Care Home

Any advice here please.
My mum has severe MS - she’s in a Care home and is on the deferred payment scheme.
Almost at the end of the credit left in her flat.
We pay 500 a month top up.
The NHS has just taken her nursing care component away and will not restate it although she still needs the nursing care.
Just any advice would be useful. TIA

You need to ask social care to review her urgently. When you say top up is this out of her income as a part payment or an amount on top? (Top ups are in addition to what the council will pay up to). The loss of nursing care will need challenging if the outcome is incorrect (have you got a letter explaining why?). When deferred payments reach the agreed limit, a social worker should review a placement, even more important in light of the loss of FNC.

I'm sorry you're going through this. Both my parents had MS and were bed bound by it. It's a bloody horrible disease.

I'm up in Scotland and my first port of call would be my local councils social work department. Your mum needs to be reassessed, she must be entitled to some level of free care. I hope you get some help soon.

Thank you.
I asked about the nursing care and was told she was on a trial and this had now stopped. No letter.
I’m also told she’s owed about 10k back payments from Attendance Allowance but have heard nothing further. They will only deal with mother directly. She hasn’t heard anything.
We have a social care review this week and the financial one is next week.
Just rung the council (again) as apparently the letter they sent re the FR was generic. It was meant to enclose various forms etc. Apparently mothers file is locked away until Monday.
My husband pays the top up so my mum has quite a bit of disposable cash from the tenants.
I know it’s ridiculous that we are out of pocket but she receives v good care and it’s a big weight off our minds.
I’m registered disabled and can’t work and my mum is compus mentis and despite her disabilities spends a lot, on herself. She has an electric wheelchair and access to shops, hairdressers and the internet when I help her.

And I have spoken to CAB and Age Uk because I wanted someone to advocate on our behalf but neither would be able.

A side issue, but does your mum have any Lasting Powers of Attorney set up in case she does lose mental capacity in future? It's just that once registered they can actually be used before capacity has been lost and therefore, if you were the attorney for her health and welfare, and for her financial affairs, then the various agencies would be able to deal directly with you.
