How do cms determine whether father is on benefits?

This thread isn't about me, it's about my sil. I just wanted to see if anybody can explain to me how cms determine whether somebody is on benefits.

My sil has had to go to cms as my brother stopped paying her any money for the dc (my parents paid it the whole time in all honestly but let's not go down that path...) she's now received a letter from cms saying my brother is only needing to pay £7 a week for the kids as he is on benefits.

As far as I am aware (and my parents) he is still working. He is self employed but for a company. (Trying not to be too outing) for example he works for a larger company and could be sacked, disciplined etc, but he sorts out his own tax payments etc. Hope that makes sense.....

Surely the cms have a way of checking that he is on benefits and don't just take his word for it?? I'm wondering if he's left his job (or been sacked) and is still pretending he's working to the family.

He's a liar (and a cheater) anyway and I don't believe a word he says but my parents still think he's the golden boy and I'm so angry at how my sil has been treated that I'm thinking of pointing out a few facts to my parents, but I want to get my facts straight first.

Thanks Smile

I'm no expert but think it goes off taxes. So he's probably not declaring his income. Ask him about it and if he carries on lying make a little call to the hmrc

Try and find out if he is still working. If so then he isn't declaring his income. In which case you can make a call to the hmrc or report it online, you can do it anonymously if you wish. I know CMS don't get involved in things that's side as my sons dad was working on the side as well as being employed so he has to be reported to the Hmrc first for their investigations.
So it's pointless going via the CMS as they cannot do anything as they go off what declared to the tax office

So the cms will have some "evidence" from taxes that he's claiming benefits? So he's also committing benefit fraud?

I seen him less than two weeks ago when he was late coming to parents because he "had to work til 2pm" e said this himself and his OW who he now lives with (yes he is such a delight, I'm so proud Hmm)

I'm my experience CMS only go off the information fed to HMRC. I can't imagine they can take his word for it.

He sounds incredible though so no doubt it claiming unemployment and working but not declaring. I'm sorry you're related to it!

HMRC

CMS are part of DWP and are linked to benefit agencies so are automatically notified when benefits start/stop.

Hairwizard · 30/05/2019 16:17

What *blah said. If he is on any benefit it will launch a service request for that change to be done which will then pass the case to a benefits team.
If you suspect hes earning as well as getting benefits report him to benefit fraud team.
