How much is a speeding fine !?

My husband got done for speeding 58 mph on a 50 mile zone on a MOTORWAY , just wondering if the new rule of % of income has come in ?? Or is it £100 fine ?? Even tho he earns £2000 a week , there's no way we could afford a fine of say £300 or something like that at one go . Would he have to by law pay it all at one go ?? After all our out goings every months we are overdrawn as it is . Really worried about it . And yes I know it's his own fault for speeding so don't need any bashing over that . Thanks

He may get offered a speed awareness course instead.

SpideyMom · 25/05/2019 09:48

I saw 2000 a week and was like holy wow, they're lucky haha.

He may be offered a speed awareness course, but I'm not sure how they determine a course or points and fine.

I received a letter of intended prosecution last year. I was devastated. I wasn't offered a course at first due to the driving without consideration apparently. However the NIP was flawed and I challenged it. It referred to speeding. Then not stopping. Then failing to comply with traffic signals. Then driving without consideration. I was like what the fuck have I done. All I could admit to was that it was my car on the photo. I faced a few arse holes and then someone took ownership and agreed it was flawed and sort of threw it out and 'downgraded it' meaning it wasn't a straight points and fine
Unfortunately I still had to do a course because apparently 'I must have done something despite them not being able to confirm what' but I found it really interesting and useful.

I do remember the Police telling me that I wasn't allowed to attend a course at first because it wasn't for speeding. How true that is I don't know.

Most imortant thing is to return the Notice of Intended Prosecution (s172) straight away and get proof of posting. Not returning it is a more serious offence than the speeding and it is 6 points.

If the police then offer a fixed penalty it will be either a £100 fine + 3 points or a speed awareness course. If it goes to court it will be based on his income. It would be band A, so 50% of weekly income. Plus court costs (£85 unless a complex case) and victim surcharge (10% of fine). If you can't pay it straight away the court will let you pay in instalments.

Does he already have any points on his licence? If this takes him to 12 points he will be offered the opportunity to go to court to explain how removing his licence would cause exceptional hardship.

rosesandcashmere · 25/05/2019 10:11

If he's got a clean license it may be a speed awareness course. Otherwise it's 3 points and £100 for that. He needs to send the form back when he gets it

Plumplump · 25/05/2019 10:21

If he is on Scotland the Speed Awareness Course isn't an option yet. So it is £100 and 3 points on his license. My hubby just got one for doing 48 on a 40 dual carriageway, right before the limit changed to 60. Notorious speed trap lol!!

looneyloo88 · 25/05/2019 11:42

Great thanks everyone ! He hasn't got any points on his license so fingers crossed it just a £100 fine at the most

Speed awareness is £100. I think he'll get offered that.

SpideyMom · 25/05/2019 11:50

Isn't it fine and points on the license. Or has it changed.
It was the points on my license I was keen to avoid

Sophiesdog11 · 27/05/2019 09:48

Speed awareness is offered if he hasn’t done one in previous 3(?) yrs and if he is only over speed limit by a certain %.

My DS got diverted off a main dual carriageway due to an accident in January, the road he was on was 60 initially but must’ve dropped - he accepts he was at fault for not noticing reduction but given that the police stopped almost every driver on that stretch of road, it does make you wonder how much signage there was! It has made him more careful on unfamiliar roads though.

He was 1mph over limit for speed awareness course, so got 3pts and £100.

Interestingly, he declared to his insurance at time - he didn’t pay any extra and his renewal doesn’t seem to be bumped up (he is 21 with 4yrs NCD)

However, one of the other quotes I got for him had a £200 increase once the speeding conviction got added. His renewal with his existing provider is less than £300 total!

Sophiesdog11 · 27/05/2019 09:56

In terms of being done for 58mph on Motorway, my DH and I both commute on a stretch of motorway that has just become smart motorway, so we have had 3yrs of 50mph roadworks.

I lost count of how many drivers seemed to be doing more than 50 in roadworks section, I do wonder how many know it is an average speed check. I did a speed awareness course about 8yrs ago, we were told someone racked up 12 Pts and a ban by going through a 50mph section of a motorway 4 times in one day, each time over the limit.

It’s not helped by lorries pushing you along, but I used to just sit in the inside lane at 50 - given that I use that stretch multiple times a week to get to work, I was not risking my licence for anyone.

Milkandcornflakes · 27/05/2019 14:17

I'm about to do my second speeders awareness course (within 6mths of each other) shamefull I know..the first one I got was at the traffic lights at Wandsworth bridge..for going through an amber light..the second one was in Lincolnshire at Easter coming back from skegness..i was doing 65 in a 60mph zone .it's definitely made me ease up and consider my surroundings ...

Macca84 · 27/05/2019 14:21

It'll probably be a speed awareness course. I done one last year, think it was £90 and it was a good course too. I won't be speeding again!

looneyloo88 · 27/05/2019 20:09

Hopefully he will get the course !! He's pretty awful for speeding anyway and I'm always shouting at him for it ! This might make him slow down a bit 😂

It’s not just the £100 fine. He will have to declare the points to his Insurer and they (and any other Insurer) will load the premiums for the next 5 years.
