No ccj registered...advice please.

I am in the process of a mortgage application with my OH. Mortgage advisor has been going through our statements and asked about a monthly payment I am making. It’s in relation to a credit card debt from a number of years ago. The debt has long since dropped off my credit file and I have been making regular payments for 5 years.

I was looking into proposing a final settlement to the dca in order to get it gone so to speak. I have spent the last few years repairing my credit file, nothing adverse on there now, just current account, credit card with low balance and a next account, again with low balance. Not been in overdraft for months, no late payments etc and everything looks good.

When I spoke with the solicitors acting for the dca they advised that if a settlement was accepted it would show on my credit file as ccj partially settled until the 6 year period is up which would be next spring and could make obtaining credit difficult. However, on checking my files with all 3 agencies as well as the ccj register at Trust Online there are no ccjs registered in my name anywhere. I am concerned if I settle this now that the ccj will now appear on my file and jeopardise the mortgage application.

Anyone have any words of wisdom on this? Really not sure what to do as mortgage advisor asking to know balance yet to be paid and whether it will be settled on completion (I’m assuming this is to inform the lender before they make their decision).

I've had something similar. Had some dmp's which had fallen off my credit file but which I'm still paying regular monthly payments. The broker didn't pick up on it and I hadn't mentioned them because as far as I'm concerned they happened years ago and I'm paying them off as arranged with credit card companies. However the mortgage lender went through my bank statements with great scrutiny and queried them with me. I couldn't afford to settle them and was just totally honest with them that they happened years ago and i was paying regularly. Mortgage lender accepted what I said and gave me a mortgage. Completed and moved in last week. I wouldn't settle them as they will query them on your statement anyway even though not showing on your credit file. They will tell you if they want you to pay off before lending to you I would guess.

Thank you so much for your reply. That has made me breathe a bit easier now. Obviously there is no guarantee of the mortgage being approved, but it’s encouraging to hear someone else’s positive experience with something similar. I also can’t afford full payment at present and am happier continuing with the payment arrangement I have, so hopefully this will be acceptable...fingers crossed. I think a lot of mortgage companies use Equifax with is the most detailed credit score so check if the CCJ is showing on there before you commit any money.

Thanks ItsHardToExplain, I have checked with Experian, Equifax and Transunion as well as paying to check the ccj register at trustonline and nothing on any of them, so hoping that’s good news. I recall getting court paperwork through with a form to complete if I was requesting time to pay. I completed this with my payment proposal in way of monthly instalments. This was put to the creditor and they accepted it so I never had to go to court. Wondering if that’s maybe why no ccj.

I don’t understand how a CCJ (partial or otherwise) could be added to your credit file if they haven’t actually been to court to get one?

If it isn’t a CCJ now, how can it be if you settle it?

It would probably show as a settled payment but not a CCJ.

Happy to accept I’m wrong though.

I don’t get it either. It’s just the person I spoke with acting for the dca said that my file would show as ccj partially settled if I can agree a settlement figure. I said there wasn’t a ccj on my file and he was very puzzled and said there should be. I didn’t question any further as I don’t want to open a can of worms, so quickly changed the subject.

Well personally I think that’s bollocks and I wouldn’t trust a ‘solicitor’ that’s associated with the DCA.

I think you can check if you have a CCJ - I think you would know to be honest - and if you don’t they can’t suddenly create one.

The forum on the money saving expert website is good for asking questions.

Well looks like I was worrying for nothing, was straight up in my application about the dca payment and that I wanted to continue with the regular payment I’m making and not offer to settle (thanks ItsHardToExplain) Mortgage offered and we complete tomorrow Grin
