Legal eagles - is it possible to find out what sentence someone was given?

Methinks the person in question is telling porky pies about what happened today in court - he was due to be sentenced for harassment, for which he was found guilty for about three months ago. Apparently, the magistrates this morning told him "there was no case to answer"? Surely this doesn't stack up, as he has already been found guilty?

Is it true that you can ring up the magistrates court three days afterwards and find out?

Anyone know please ?

Criminal defence solicitor replying here!

Its a matter of public record now that the case has (maybe) finished. You may find that the court is helpful but they may cite Data Protection or some other such nonsense but it is matter of public record. I doubt that the Magistrates told him no case to answer if, as you say, he was found guilty 3 months ago. Why has it taken so long for him to get back to court if the verdict was in 3 months ago? Normally it would be 3 weeks or thereabouts after the conviction or plea of guilty to sentence on an harrasment charge.

Oooh brilliant how great to have such expertise online!

I've just checked the press article regarding the original case, and actually it was around the 16th June, so three weeks (not months - SAHM can lose track of time!!) does figure. Following the guilty verdict (and plea..) the judge was particularly vehement about what a nightmare this man had made the life of the ex employee he was harassing, so when it came to sentencing (and bearing in mind I know zero about these matters) "not having a case to answer" just doesn't seem to ring true.

So can I ring the magistrates court and find out then? I think it will be in the press and can do a search in a few days, but I'd rather know the facts straight away.

Thanks!

If you were the victim you would be entitled to know under the The Code of Practice for Victims of Crime

6.7 Where a criminal trial is held in respect of relevant criminal conduct, the joint police/CPS Witness Care Units must notify any vulnerable or intimidated victim of the outcome of all pre-trial hearings (including applications for special measures directions under section 19 of the Youth Justice and Criminal Evidence Act 1999) and the verdicts of the trial, including the sentence if the suspect is convicted, no later than one working day after the day of receipt of these decisions from the court,
and must notify other victims of the sentence (or any not guilty verdict) no later than

Lilymaid · 18/07/2007 17:14

Sorry - didn't paste it all - the end of the sentence is:

one working day after the day of receipt of the sentence or not guilty verdict from the court.

moodlumthehoodlum · 18/07/2007 17:15

I'm not the victim, nor have anything directly to do with the case other than being related to, and being worried about his current partner...

All useful information though. Its a tricky one to know what's best to do, but always best to work on the premise that its better to know these things, even if you don't always impart that information!

You might be lucky and find the case was covered in the local papers, but I imagine that only a minute proportion of cases ever get in there.

moodlumthehoodlum · 18/07/2007 17:21

Well it was followed by a national paper and the local press, so I think we can find out that way if no other, I'd just rather find out sooner.

Have to wait until monday. Rang magistrates court this am to be told that there is three days grace before the sentence is made public. So monday morning will be back on it, unless i can find something in the press first.
