Quick run down -

Purchased a hot tub a year ago from a company who had a concession within a local store. A few problems initially - some of the extras we requested were then not available on our chosen model. To compensate the store discounted the price, so fair enough.

It now appears that the tub was defective from day one - ie. not level. A guy came out from the tub co. to look at it, and conceded that it had left the factory like it and had also got worse since installation.

They are happy to replace it but here is the sticking point:

Since having the tub we have enclosed it in a summerhouse which will need to be dismantled to get it out and the new one in, and then rebuilt. We are asking them to cover the cost of this (about £800).

They are refusing at mo and looking at 'other alternatives'. One of which is if they can get it out through the double doors at the front. The problem with this is it would then have to be taken out through a different exit point in the garden which would mean digging up plants/shrubs etc.

I feel we are completely in the right here and they should cover the cost of the dismantling as the tub was defective upon delivery, just unfortunate that it wasn't noticed until the summerhouse was built.

Thanks for reading this far - can anyone advise on our legal postion?

Sorry about your predicament ? it must be infuriating for you. Strictly speaking I don?t they are legally obliged to cover the costs of replacing the tub within the Summer house but like you, I would certainly be pushing for compensation as a result of all the hassle they have caused. You might get further if you try and get them to give you extras or free servicing or something instead ? just an idea. I hope you get somewhere soon.

thanks mrs mcjnr. Will have a think about your idea of extras/servicing etc - could be a useful one! The thing that really winds me up is that the 2 companies involved could cough up £400 which in the grand scale of everything is peanuts to them!!!!

I suggested this before to someone who needee legal help: if you've got house buildings / house contents insurance, either check your docs or ring the companies and ask if you've got family legal protection , or legal cover, it's and extra they either try to flog or just stick on your policy, and one of it's usual features is a (poss 24hr) legal helpline where sol's or some like will answer any legal q's: also, if you have the cover you shouild also have a 'fund' of some odd amount liek £50k to use if you want to have some welly and tak legal acion against someone: would definately suggest you use this is you have the cover as it should be of some help and should cost yu nothing coz you bought the legal cover hence all the associated services are free / under the cost of the legal cover. Hope this helps
