help me kick arse over my crappy bath situation

this is petty in the grand scheme of things, i know it is.

when we moved in here there was already a corner bath unit fitted in the bathroom. the panel was already cracking but not badly so. i was unsure about it, but looked into the tenacy agreement and it states that any applicances and fittings left by previous owners than the council didnt remove, would then become responsiblity of the council to upkeep them.

fast forward to now, the panel is now broken and dangerous, and the seal has gone round the tub. so have had to council in. they are refusing to do the panel as its not 'council issue fittings' they wont replace the tub to council issue normal tub. all they will do is seal it round the edges. So i will still have water leaking over the edge of the tub and running to the back of the floor underneath, which will require mopping daily. and its not easy to mop under a bath each day, i can tell you.

petty i know, but where do i stand? can i insist they sort out the panel or so i admit defeat already.

grr on your behalf misdee! I would write a letter to the head of the appropriate department (addressed to them in person) and quote the relevant part of the tenancy agreement. Also reiterate that this is not a bath you have put in, but was left by the previous tenants. Point out that it is dangerous and that you have small children and a dh who needs constant care. Then state specifically what you want them to do about it - ie replace the bath with a safe one. Make sure the letter states clearly both the problem and the solution. Be polite but firm. HTH

they say they wont put a new bath in as it will mean moving the radiator.

because of all this there is mold above the bath which is proving hard to shift.

i have windows open and extractor fan on almost all the time.

Who put the bath in in the first place? Tenants or council (or don't you know?)

Can you play on dd1's asthma a bit re the mould? (I don't mean "play on" in a bad way, just point out that there are medical implications)

dd1+2 both has asthma, and dh will have to careful regarding mold spores after tx.

i just feel like ripping the thing out and having it as a showeroom only. but the girls need baths due to eczema.

it was put in by previous tenants. but the council left it there when they moved out, so maintance is then passed to council.
