In a terrible mess with bailiffs bleeding us dry - please help

I am desperate for help. I will report this post when I finish it because I want MN to post the usual message and so hopefully people understand it is advice I am seeking, not any sort of financial assistance.

My young adult son has ASD and is high functioning but vulnerable and very naive - like a younger boy in many ways. He drove through the dartford tunnel around a year ago. He did not know it was chargeable (we aren’t local to the area and I’ve never been.)

I got a phone call from a neighbour at a flat we let to say there had been a visit from a bailiff - it transpires DS put this as his address on his driving licence; he passed his test at 18 and thought it made him ‘cool’ having ‘his’ flat. That’s what he said anyway. Hence the letters about it have not come home and we were unaware of this.

I had to pay nearly £600 in bailiffs costs and obviously I was horrified, but thought it was a one off and so put it down to one bad experience.

However there have now been three of the things and there is another - I emailed the company and was told to call them urgently on Friday and then when I was at work I was getting phone calls from an unknown number, one after the other after the other.

It’s utterly horrendous. By now they have had nearly three thousand pounds from me.

I just desperately need to know my rights here. They say they can change the locks at the address DS put down even though there are now tenants there - I don’t know if this is the case. I’m actually terrified.

My son does not receive PIP but the thread has become about something different to my original intention so I am going to hide it. Apologies to those who posted with helpful advice but I refuse to use a site where posts like Bollocks are condoned and I have contacted MN to say the same.

Does he drive? Have you ever been through thr dartford crossing? Because if the answer to both is yes, then that's deeply concerning for your son. And other road users. Those signs are enormous, and there are a huge number of them. Over head, at the side of the road, everywhere.

flowery makes a good point. Letters would have been sent to the address at which the car is registered. Is that the same address as the rented flat?

Also, are you sure these are genuine bailiffs or debt collectors? £3k seems an awful lot of money for a fine or two.

Okay, final post.

DS is a very safe driver, to the point of being quite annoying. However he naive and he is vulnerable. It is entirely possible he saw he needed to pay but did not know how. Anyway with respect that is not why I posted.

I outlined in my op the confusion with the bailiffs letters going to the wrong address and this is where DS was at fault and we both acknowledge this.

Finally, I total I have paid nearly three thousand pounds - that is over several months. I am contacted to ring them urgently and am informed I owe £479/£540 andso on. It was not £3000 in one go.

I don’t intend to return as I need expert advice and I hoped someone who knew this might be on MN his evening but many of you haven’t even read my op and just wanted to bash a young man for having the tenacity to have a driving licence.

I agree with this.

Also where is his car registered as that is where his letters will be going.

He can also get into serious trouble if he doesn't have his corrrct address on his driving license.

Did he also register the car to that address? Because as a PP said, they contact the registered keeper from the number plate.

The problem you have is that the mitigation for the toll, fine and bailiffs costs (“the correspondence went to an address he doesn’t live at”) implicate him in things which are an offence (not having licence and log book registered to your home address).

In your shoes I think I would try CAB ASAP.

Horrrible situation to be in. Why didn’t your tenants forward the mail? Or if they didn’t recognise the name, RTS? The letters must have loooked very official.

So far I think the op is aware of four or five of these crossings from what she's said, but it's hard to understand, and it can easily get to this level, especially if it went to court.

Op, has he told you how many times he has been through the crossing? Because if it's repeated, effectively if you chose to pay, it could cost you everything you have, I think you need to understand clearly how many times he's been through this, and seek legal advice.

And the pp is right, the letters should go to where the car is registered.

But him putting that address on his driving licence wouldn’t result in this. This should only happen if he is the registered keeper of the car, and the car is registered at that address.

But you don’t owe them anything, surely? Your son does. Why are they contacting you?

Are you really sure it’s not some kind of scam?

Hang on but if he's an adult why are you being forced to pay the bailiffs? If your son doesn't own either property why do you have to pay?

I don't quite understand. He may be living at your property but it isn't your debt.

Why are they pursuing you?

Pp are right these fines go to the registered keeper of the car. So does this mean his car is registered at the flat too. If it is you need that addressed immediately before he gets in more bother

Id also be wondering what else hes used this address for. What other debts might he be running up

Have you actually rung the Dartford Tunnel People to as about the charges? How many times he crossed, what the out standing sum is/was? Has it been settled now etc?

I had this issue last year & found them very helpful

Oh OP I know it sounds harsh but have you ever seen the signage? Even people who don't speak English can understand it. If he didn't then he shouldn't be driving because that indicates that his situational awareness is shocking. Small children can make sense of it. My 4 year old niece gleefully reminds me to pay it when I drive through. It's terrifying that he is even on the road if his understanding is that limited. If he is fit to drive then you are underestimating him and like every other son in the world, is making an attempt to pull the wool over your eyes.

The bills would go to the address of the registered owner of the car, not a licence holder. You can create an online account for dartcharge. Register the licence plate and you get notifications if the balance dips , uses and if you need to top up. Not sure if you can see it retrospectively though but it moght prevent it recurring. There have been issues with dartcharge fees inflating through debt collectors and I believe there is an appeal process. Maybe google it and see if you can complain.

Op I get it. - my boy has asd and does not always register the consequences of things.

My son is being chased by debt collectors too. For what I don't even know. - the letters get returned as he no longer lives with either me or his dad. I dread to think about it really

You really need to know how many times he went thru and I'd get some legal advice now - and stop paying for him.

It's really hard and I spent a long time trying to sort out ever increasingly complicated debts but have given up now. He has to understand there are consequences.

Can you contact the original debtor to find out how many times he went through and how much he is likely to owe?

I hope he hasn’t been anywhere near the Congestion Charge zone. Has he?

Repeated calls from unknown numbers? Are you paying over the phone each time?

A previous post about getting in touch with the court sounded half useful.

I’d also stop paying, as it’s not your debt. I’ve (sadly) had to use debt collection agencies to recover money owed by individuals and I’ve actually found them really quite toothless.

Op, if it helps, here is an image of one of the signs, it does tell you to pay on line. These signs are everywhere, and as said are huge.

The op is clearly not getting a kicking, nearly everyone is trying to help her, Although I understand she is not receptive and only wishes to know her legal rights, and as it stands this is not her debt. It's her sons, and getting proper legal advice is the best way forward.

She may not be getting the advice she wished, but I also am guessing she wasn't looking for a BFF either.

This could be a scam. I've received letters with photo saying I was driving in X place. When I checked in my diary, I was 100s of miles away. I wrote back confirming that it was not me. I received no further letters. Your son, must put his current address on his driving license via DVLA. If he doesn't understand about toll roads, he needs to be educated, there are several in UK & abroad
